Violations of Regulations on Private Tutoring: Teachers May Be Fined Up to 15 Million VND

This is one of the notable contents mentioned in the Draft Decree on administrative sanctions in the field of education, replacing Decree 138/2013/ND-CP.

Draft tightens regulations on tutoring activities and the organization of tutoring by teachers more strictly compared to the current regulations in Decree 138/2013/ND-CP. To be specific:

Regarding the organization of tutoring activities, the following fines are proposed:

- Organizing tutoring activities without ensuring facilities: A fine ranging from 2,000,000 VND to 3,000,000 VND.

- Failure to disclose information about the organization of tutoring as required: A fine ranging from 2,000,000 VND to 4,000,000 VND.

- Teachers receiving salaries from the public service provider's wage fund organizing tutoring outside the school: A fine ranging from 3,000,000 VND to 5,000,000 VND.

- Using unqualified tutors as per training standards: A fine ranging from 4,000,000 VND to 6,000,000 VND.

- Organizing tutoring for official school classes: A fine ranging from 6,000,000 VND to 8,000,000 VND.

- Organizing tutoring at unauthorized locations; organizing tutoring for unauthorized groups or content: A fine ranging from 6,000,000 VND to 8,000,000 VND, with the additional sanction of suspending the tutoring permit for 6 to 12 months.

- Intermediate pedagogical schools, colleges, and universities organizing extra teaching according to the general education program: A fine ranging from 8,000,000 VND to 10,000,000 VND.

- Organizing tutoring activities with an expired permit: A fine ranging from 8,000,000 VND to 10,000,000 VND, with the additional sanction of suspending tutoring activities for 12 to 24 months.

- Forcing students to attend extra classes: A fine ranging from 8,000,000 VND to 10,000,000 VND.

- Organizing tutoring activities without a permit: A fine ranging from 10,000,000 VND to 15,000,000 VND.

Additionally, teachers who violate regulations on tutoring must refund the collected fees to students and bear all costs associated with these refunds for unauthorized student groups, unauthorized content, expired permits, or no permit; and forced attendance in extra classes.

Regarding individual tutoring activities, the proposed specific fines are:

- Tutoring outside the school by teachers who are teaching official classes without the principal’s permission: A fine ranging from 2,000,000 VND to 4,000,000 VND.

- Unqualified tutors: A fine ranging from 4,000,000 VND to 5,000,000 VND.

- Tutoring elementary students or students already attending two sessions per day: A fine ranging from 5,000,000 VND to 6,000,000 VND.

- Reducing content in the official general education program to include it in extra teaching, or tutoring ahead of the official general education program content: A fine ranging from 6,000,000 VND to 8,000,000 VND.

Thus, if this Draft is passed, the tutoring activities of teachers will be more tightly controlled, partially limiting the situation of forcing students into extra classes; widespread unauthorized tutoring;...
