According to Vietnam’s regulations, the vocational education institution may only enroll students or provide training when it is granted the Certificate in vocational education registration. However, during its operation, for some reason these institutions may be suspended from operation. So, in what cases shall a vocational education institution be suspended its vocational education operation?
1. Cases of suspension of vocational education
According to Article 20 of the Law on Vocational Education 2014 of Vietnam, a vocational education institution shall be suspended its vocational education operation in the following cases:
- Commit fraud acts in order to be established or permitted for establishment or receive the Certificate in vocational education registration;
- Do not satisfy one of requirements as prescribed in Clause 1 Article 19 of this Law;
- Organize vocational education activities when it is not granted the Certificate in vocational education registration;
- Commit violations against law on vocational education and face administrative penalty on suspension of activities;
- Other cases as prescribed.
2. Procedures for suspension of vocational education
According to Article 20 of the Law on Vocational Education 2014 of Vietnam, Article 21 of Decree No. 143/2016/NĐ-CP of Vietnam’s Government, suspension of vocational education shall be carried out as follows:
- The registration certificate issuer shall carry out inspection to assess the seriousness of violations stipulated in Clause 1 Article 20 of the Law on Vocational Education 2014 committed by vocational education institutions and vocational training facilities.
- According to the seriousness of a violation, the registration certificate issuer shall consider making a decision on suspension of vocational education.
- A suspension decision shall specify reasons for suspension, duration of suspension and approaches to protect lawful interests of students, teachers, lecturers, officers, staff and employees. Suspension decisions shall be informed to relevant agencies for cooperation in implementation and shall be made publicly on means of mass media.
- After the suspension period, if mistakes leading to suspension are already corrected, the competent authority that made the suspension decision shall give permission to continue to provide vocational education.
