Conditions for registration of vocational education in Vietnam

The Law on Vocational Education 2014 of Vietnam was issued on November 27, 2014. This Law officially came into force from July 01, 2015. One of the notable contents of this Law is the regulation on conditions for registration of vocational education as well as the order and procedures for granting the Certificate of registration of vocational education activities.

1. Conditions for registration of vocational education

According to Article 19 of the Law on Vocational Education 2014 of Vietnam, a vocational education institution, a higher education institution, or an enterprise shall be granted the Certificate in vocational education registration if it meets all requirements below:

- There is a decision on establishment or a permission for establishment;

- There is land, facilities, or equipment meeting requirements pertaining to training activities according to the commitment;

- There are sufficient training programs, teaching and learning materials as prescribed;

- There are teaching staff and administrative officials of vocational education who have equalizations and sufficient quantity, uniform structure;

- There is necessary finance resource as prescribed to ensure the maintenance and development of the vocational education;

- There are regulations on organization and operation.

Details of these conditions are specified in Article 14 of Decree No. 143/2016/NĐ-CP of Vietnam’s Government.

The vocational education institution may only enroll students or provide training when it is granted the Certificate in vocational education registration.

The vocational education institution wishing to change the information in the Certificate in vocational education registration shall apply for additional registration to the competent authority.

2. Application for provision of vocational education

According to Article 15 of Decree No. 143/2016/NĐ-CP of Vietnam’s Government, application for provision of vocational education is prescribed as follows:

- For private and public vocational education institutions, the application includes:

+ An application made using Annex III attached hereto;

+ A copy of the decision on establishment and decision on grant of permission to establish the vocational education institution;

+ A report on fulfillment of conditions for provision of vocational education made using Annex Va attached hereto and other proofs;

+ A copy of the operation regulation of the vocational education institution.

- For foreign-invested vocational education institution, the application shall be made in Vietnamese or both Vietnamese and English, including:

+ An application made using Annex III attached hereto;

+ Copies of the registration certificate (if any) and decision on grant permission to establish the vocational education institution;

+ A report on fulfillment of conditions for provision of vocational education made using Annex Va attached hereto and other proofs;

+ A copy of the operation regulation of the vocational education institution.

* For vocational training facilities, the application includes:

+ An application made using Annex III attached hereto;

+ A copy of the decision on establishment or decision on grant of permission to establish the vocational training facility or registration certificate (if any);

+ Reports on fulfillment of conditions for provision of vocational education made using Annex Vb attached hereto and other proofs;

+ A copy of the charter or operation regulation of the vocational training facility.

3. Procedures for registration and issue of registration certificates

- For colleges and universities:

Step 1: Submitting application

Each applicant shall submit an application for provision of vocational education to the General Directorate of Vocational Training.

Step 2: Issue of registration certificates

Within 10 working days from the date of receipt of a valid application, the General Directorate of Vocational Training shall assess the applicant’s ability to provide vocational education and consider issuing a registration certificate.

- In case of rejection, the General Directorate of Vocational Training, within 05 working days, shall inform the applicant in writing which specifies reasons for rejection.

- Within 05 working days from the date of issue of the registration certificate, the General Directorate of Vocational Training shall submit a copy of the registration certificate to the Department of Labor, War Invalids and Social Affairs of the province where the college/university provides vocational education for administration.

* For vocational schools, vocational training centers and enterprises:

Step 1: Submitting application

Each applicant shall submit an application to the Department of Labor, War Invalids and Social Affairs where the applicant’s headquarters is located. Where vocational education is provided at a branch or location other than the province where the headquarters is located, the applicant shall submit an application to the Department of Labor, War Invalids and Social Affairs of the province where that branch or training site is situated.

Step 2: Issue of registration certificates

Within 10 working days from the date of receipt of a valid application, the Department of Labor, War Invalids and Social Affairs shall assess the applicant’s ability to provide vocational education and consider issuing a registration certificate.

- In case of rejection, the Department of Labor, War Invalids and Social Affairs, within 05 working days, shall inform the applicant in writing which specifies reasons for rejection.

- Within 05 working days from the date of issue of the registration certificate, the Department of Labor, War Invalids and Social Affairs shall submit a copy of the registration certificate to the General Directorate of Vocational Training for administration.
