Vietnam: Exemption from serving prison sentences for people suffering from full-blown AIDS

Vietnam’s Government has lenient regimes for people with terminal AIDS to facilitate treatment and avoid the worst cases that may occur during the execution of punishment.

To be specific:

- If a person who is being investigated, prosecuted or tried has full-blown AIDS, he/she shall be granted suspension of investigation or suspension of the criminal case;

- If a person who has been sentenced by a court has full-blown AIDS, he/she shall be granted remission of the serving of the penalty, reduction of the penalty-serving term or postponement or suspension of the serving of the imprisonment sentence;

- If a person who is subject to a decision on the application of the measure of confinement to a medical treatment establishment, an educational establishment or a reformatory has full-blown AIDS, he/she shall be granted postponement or remission of the serving of such decision or postponement, suspension or remission of the serving of the remaining term.
