Vietnam: Dossier for settlement of lump-sum survivorship allowance for military personnel

On October 29, 2020, the Ministry of National Defense of Vietnam issued the Circular No. 136/2020/TT-BQP providing guidance on dossiers, processes and responsibilities for handling social insurance benefits within the Ministry of National Defense.

According to the Article 33 of the Circular No. 136/2020/TT-BQP of the Ministry of National Defense of Vietnam, dossier for settlement of lump-sum survivorship allowance for military personnel; people doing cipher work receiving salaries like military personnel; national defense officials, workers and public employees; contract workers in agencies, units and enterprises under the Ministry of National Defense (hereinafter referred to as employees) according to Article 111 of the Law on Social Insurance of Vietnam includes:

- Dossier according to instructions in Clauses 1, 2, 3 and Point a, Clause 8, Clause 9, Article 31 of this Circular.

- A copy of the payment process of social insurance (Form No. 04A-HBQP).

- Decision on lump-sum survivorship allowance (Form No. 08C-HBQP).

- Minutes of agreement of relatives in case they are eligible for monthly survivorship allowance as prescribed but choose to receive lump-sum survivorship allowance (Form No. 09C-HBQP, original).

Concurrently, according to Article 33 of the Circular No. 136/2020/TT-BQP, the process and responsibilities for settlement of survivorship allowance benefits are as follows:

* For employees' relatives

- Submit dossier according to instructions in Clause 3 and Points b, c, d Clause 8 and Clauses 9 and 10 Article 31 of this Circular, the first-time occupational disease treatment medical record guided at Point a Clause 8 Article 31 of this Circular (for cases of death due to occupational diseases); in case the relative is eligible for monthly survivorship allowance but choose to receive lump-sum survivorship allowance, he/she shall submit additional documents as guided in Clause 4 Article 32 of this Circular to the personnel agency at the regiment level and the equivalent where the employee worked before his/her death;

- The employee's relative or guardian may directly or ask another person to submit an application for settlement of social insurance benefits, but must directly receive the settlement result and the social insurance benefit; in case it is not possible to receive directly, a letter of authorization (Form No. 13B-HBQP) or an authorization contract as prescribed by law for their legal representative must be obtained to receive the results of settlement of social insurance benefits.

* The employer is responsible for implementing the instructions in Clause 2 Article 29 of Circular No. 136/2020/TT-BQP.
