Vietnam: Cases in which national defense workers are exempted from vocational skills assessment

According to Article 24 of the Circular No. 142/2020/TT-BQP of the Ministry of National Defense of Vietnam, national defense workers are exempted from examination and assessment of occupational skills when meeting the following conditions:

1. National defense workers participating in world skills contests, ASEAN skills contests or national skills contests who win medals will be entitled to their results reserved, considered, and upgraded to one level of occupational skill level and entitled to be issued with a new vocational skill qualification certificate next to the current level of vocational skill level.

2. National defense workers shall be considered for exemption from examination and granted a certificate of new vocational skills when the time limit for examination of occupational skill level is due in the following cases:

- Participating in a technical contest (sports festival) at the whole army level with excellent grades or participating in a technical contest (sports festival) at the military service level, army service, military zone, army corps and the equivalent and winning third prize or higher;

- For the term of keeping the vocational skill level up to 02 (two) years, at least 01 (one) year must be awarded the title of Emulation Fighter at grassroots level or higher during the period of holding the rank (since the last examination of vocational skill level);

- For the term of holding the vocational skill level from 03 (three) years to 04 (four) years, at least 02 consecutive years of being awarded the title of Emulation Fighter at grassroots level or higher during the period of holding the rank (since the last examination of vocational skill level);

- For the term of holding the vocational skill level from 05 (five) years or more, at least 03 consecutive years of being awarded the title of Emulation Fighter at grassroots level or higher during the period of holding the rank (since the last examination of vocational skill level).

3. In case of exemption from examination of vocational skills, it must be considered and appraised by the Council for Examination of Vocational skills before requesting competent authorities to consider and decide. Each title won is prioritized only once, not considered for exemption from examination 2 times in a row for the case of Emulation Fighter.

4. In case a national defense worker is enjoying a salary level lower than the corresponding skill level in Appendix 1 issued together with Circular No. 142/2020/TT-BQP, until the due date and eligible for salary increase, the salary increase will be considered by the unit's salary council according to regulations without having to check the vocational skill level.

5. In case a national defense worker is enjoying a salary grade higher than the occupational skill level, the occupational skill level corresponding to the current salary level must be checked. The time to be considered for taking part in the vocational skills test is prescribed as follows:

- For the period of examination of vocational skill level of 24 months, the period of holding the vocational skill level must be at least 12 months;

- For the period of examination of vocational skill level of 36 months, the period of holding the vocational skill level must be at least 24 months;

- For the period of examination of vocational skill level from 48 months to 60 months, the period of holding the vocational skill level must be 36 months or more;

- For the period of examination of vocational skill level of 72 months, the period of holding the vocational skill level must be at least 48 months;

6. For car drivers performing regular duties, if they are granted a certificate by a competent authority to ensure the number of safe kilometers in operation within the time limit until the test period, only the theory test will be carried out.

7. For employees on duty as storekeepers and preservers at technical facilities, only theory tests are performed.
