Regarding this issue, LawNet answers as follows:

On February 15, 2024, the Minister of Planning and Investment issued Circular 01/2024/TT-BKHDT providing guidance on providing and posting information on contractor selection and bidding document templates on the National Bidding Network System.

To issue, amend, and clarify invitations for expression of interest documents, invitations for pre-qualification documents, and E-HSMQT, E-HSMST as of January 1, 2024 in Vietnam

According to Article 13 of Circular 01/2024/TT-BKHDT, regulations on issuance, amendment, and clarification of invitations for expression of interest, invitations for prequalification, E-HSMQT, and E-HSMST are as follows:

(1) Issuing invitation for expression of interest, an invitation for pre-qualification, E-HSMQT, E-HSMST

- Expression of interest documents, pre-qualification documents, E-HSMQT, and E-HSMST are released for free on the System immediately after successfully posting the notice inviting prequalification, notice inviting interest, E-TBMQT, and E-TBMST on the System.

During the process of posting the notice of invitation for pre-qualification, notice of invitation for expression of interest, E-TBMQT, and E-TBMST, the bidding party must attach the decision to approve the invitation for expression of interest, invitation for pre-qualification document, E-HSMQT. , E-HSMST; The invitation for expression of interest, invitation for pre-qualification, E-HSMQT, and E-HSMST have been approved.

Investors and bidding parties are not allowed to issue paper copies of the invitation for expression of interest or prequalification documents to contractors. In case the investor or bid solicitor issues a paper copy to the contractor, the paper copy has no legal value for preparing and evaluating the expression of interest and pre-qualification application.

- In case the content of the invitation dossier, pre-selection invitation dossier, E-HSMQT, E-HSMST posted on the System differs from the approved content of the invitation dossier, pre-selection invitation dossier, E-HSMQT, and E-HSMST issued on the System shall serve as the basis for establishing and evaluating the interested dossier, pre-selection dossier, E-HSQT, and E-HSDST.

(2) Amending the request for interest documents, the invitation documents for E-HSMQT, E-HSMST

- For non-online contractor selection, in the event of amending the invitation for expression of interest documents or invitation for prequalification documents after publication, the soliciting party must post the documents in one of the following two ways on the System. : Amended decision with revised contents of the invitation for expression of interest and pre-qualification documents; or the decision to amend and the request for expression of interest documents, invitation for pre-qualification documents have been amended, the request for expression of interest documents, invitation for pre-qualification documents have been amended, and the revised content must be clearly stated.

- For online contractor selection, in the event of amending E-HSMQT, E-HSMST after issuance, the bid solicitor must post the following documents on the System: The revised decision includes the revised contents of E-HSMQT and E-HSMST; E-HSMQT, E-HSMST have been revised.

(3) Clarify the invitation for interest documents, recruitment documents for E-HSMQT and E-HSMST.

- In case it is necessary to clarify the request for expression of interest documents, pre-qualification documents, E-HSMQT, or E-HSMST, the contractor sends a request for clarification to the bidding party through the System within at least 03 working days. before the bid closing date;

- The bid solicitor posts documents clarifying the invitation for expression of interest, pre-qualification documents, E-HSMQT, and E-HSMST on the system at least 02 working days before the bid closing date;

- Clarifying contents of the invitation for expression of interest, invitation for pre-qualification, E-HSMQT, and E-HSMST documents must not be contrary to the content of the approved invitation for expression of interest, pre-qualification, E-HSMQT, and E-HSMST documents. In case the receipt of requests to clarify the content of the invitation dossier, pre-selection invitation dossier, E-HSMQT, and E-HSMST requires amendments to the invitation dossier, pre-selection invitation dossier, E-HSMQT, and E-HSMST, the amendments to the invitation dossier, pre-selection invitation dossier, E-HSMQT, and E-HSMST shall be carried out according to the provisions in paragraph.
