Regime and Policies for Individuals Involved in Firefighting

Law on Fire Prevention and Fighting amended in 2013 stipulates that individuals involved in firefighting are entitled to material compensation policies in cases of death, injury, health damage, or property loss. To be specific:

Individuals mobilized and directly engaged in firefighting and supporting firefighting activities as per the summons and mobilization orders of competent authorities are entitled to benefits as follows:

- If the firefighting duration is less than 2 hours, a compensation equivalent to 0.5 days of the statutory pay rate will be provided;- If the firefighting duration is from 2 hours to less than 4 hours, a compensation equivalent to 0.75 days of the statutory pay rate will be provided;- If the firefighting duration is 4 hours or longer, or for firefighting over multiple days, every 4 hours, a compensation equivalent to 1 day of the statutory pay rate will be provided. If firefighting is conducted at night from 10 PM to 6 AM, the compensation will be calculated at double the above rates.- In the event of accidents or injuries, medical examination and treatment costs will be covered. If an accident results in reduced working capacity as concluded by the Medical Assessment Council, the concerned person will receive compensation according to the degree of incapacity. In the event of death, funeral expenses and a death benefit will be provided. These compensations are paid by social insurance and health insurance organizations according to regulations; if the person has not participated in health insurance and social insurance, the local budget or managing agencies will ensure payment.- If the injury falls under the categories specified in the Ordinance on preferential treatment for revolutionary contributors, it will be considered for policies applicable to wounded soldiers or similar.- If the death falls under the categories specified in the Ordinance on preferential treatment for revolutionary contributors, it will be considered for recognition as a martyr.

Depending on the specific conditions of each locality, the Chairman of the Provincial/Municipal People's Committee directly under the Central Government will present to the People's Council at the same level for a decision on regular support levels for positions such as Team Leaders and Deputy Team Leaders of the civil defense team, with the support not being less than 25% of the statutory pay rate.

Non-specialized Team Leaders and Deputy Team Leaders of workplace firefighting and prevention teams are, in addition to receiving their regular salary and other allowances (if any), also entitled to regular support paid by the managing agencies. Based on actual conditions, the head of the agency or organization decides the support level for each position, which must not be less than 0.3 of the statutory pay rate.

Members of civil defense teams participating in firefighting and prevention training courses will receive a daily allowance equivalent to 1.5 days of the statutory pay rate; members of workplace and specialized firefighting teams during the training period will be entitled to leave from work, maintain their regular salary and other allowances (if any), and receive a daily compensation equivalent to 0.5 days of salary.

Participants as stipulated in Clause 4 of this Article, during firefighting and prevention training, who suffer accidents, health damage, or death will be entitled to social insurance benefits. If they have not participated in compulsory social insurance, the local budget or managing agencies will ensure payment.
