Regarding this issue, LawNet would like to answer as follows:
On March 16, 2024, the Minister of Health issued Decision 642/QD-BYT on announcing administrative procedures in the field of Traditional Medicine and Pharmacy specified in Circular 02/2024/TT-BYT.
Specifically, subjects that must take the test include:
(1) Subjects who have been standardized as physicians and have all the course certificates specified in Point a, Clause 1, Article 2 of Circular 02/2024/TT-BYT before June 30, 2004 but have not been tested. .
(2) Subjects who have been granted specialized herbalist certificates by the Vietnam Central Oriental Medicine Association before June 30, 2004.
(3) Subjects who have been trained by the Vietnam Pure Land Lay Buddhist Association and have been granted a certificate of level 2 or higher medical degree by the Central Executive Committee of the Vietnam Pure Land Lay Buddhist Association (according to the classification of the Pure Land Buddhist Association of Vietnam) before June 30, 2004.
The procedures for issuing herbalist certificates to subjects who must take the exam as of March 15, 2024, are as follows:
Step 1: The individual shall send 01 set of documents to the competent authority as prescribed in Article 3 of Circular 02/2024/TT-BYT:
Step 2: After receiving the application, the application receiving department sends the application receipt according to Form No. 02, Appendix I issued with Circular 02/2024/TT-BYT.
In the event that the dossier is not valid, within 05 working days from the date recorded on the dossier receipt note, the competent agency must notify the applicant to request additional information.
Step 3: Within 10 working days from the date of receiving the valid dossier, the Examination Board Secretariat must review the dossier:
- In cases of ineligibility, the competent authority must notify the applicant in writing and clearly state the reason.
- If eligible, the Secretariat prepares a list to submit to the Council.
Step 4: Within 10 working days from the date of receiving the list from the Secretariat, the Examination and Examination Council must meet to resolve:
- In case you are eligible to take the test, the competent authority specified in Article 3 of Circular 02/2024/TT-BYT must develop a plan, organize the test, and score the test.
- In case you are not eligible to issue herbalist certificates or are not eligible to take the test, the competent authority specified in Article 3 of Circular 02/2024/TT-BYT must notify the applicant in writing of the reason.
Step 5: After 15 days of testing
- In the event of passing the test results, the Council Secretariat submits them to the competent authority as prescribed in Article 3 of Circular 02/2024/TT-BYT to issue herbalist certificates.
- In the event that the test results are not met, there must be a written notification of the test results to each subject.
Conditions for issuing herbalist certificates are as follows:
(1) Conditions for issuing herbalist certificates for subjects specified in clause (1) of section 1:
- Having a total of 10 course certificates issued by medical, pharmaceutical, or the Central Vietnam Traditional Medicine Association, or traditional medicine healthcare facilities (Institutes, Traditional Medicine Hospitals) in coordination with intermediate or higher medical schools, provincial or municipal Traditional Medicine Associations (hereinafter referred to as Provincial Traditional Medicine Associations) for standardization training and certification before June 30, 2004. The course certificates include:
+ Basic theory of traditional medicine;
+ Certificate in pathology and treatment of internal diseases;
+ Certificate in pathology and treatment of surgical diseases;
+ Certificate in pathology and treatment of pediatric diseases;
+ Certificate in pathology and treatment of gynecological diseases;
+ Certificate in pathology and treatment of diseases of the five senses;
+ Certificate of treatment using non-drug methods;
+ Certificate in pharmacology;
+ Certificate in preparation;
+ Certificate in traditional medicine.
- Education level: People born before January 1, 1960, and ethnic minorities must be able to read and write the Vietnamese language fluently; people born on January 1, 1960, or later must have a high school diploma or equivalent.
- Having passed the examination according to the regulations in Circular 02/2024/TT-BYT.
(2) Conditions for issuing herbalist certificates for subjects specified in clause (2) of section 1:
- Having specialized herbalist certificates issued by the Central Vietnam Oriental Medicine Association before June 30, 2004.
- Satisfying the conditions specified in Points b and c, Clause 1, Article 2 of Circular 02/2024/TT-BYT dated March 12, 2024.
(3) Conditions for issuing herbalist certificates for subjects specified in clause (3) of section 1:
+ Having a certificate of medical qualification level 2 or higher (according to the classification of the Pure Land Lay Buddhist Association of Vietnam) issued by the Central Executive Committee of the Pure Land Buddhist Association of Vietnam before June 30, 2004;
+ Satisfying the conditions specified in Points b and c, Clause 1, Article 2 of Circular 02/2024/TT-BYT.
