Plan for providing legal assistance to small and medium-sized enterprises in 2024 by the Ministry of Industry and Trade of Vietnam (Internet image) 

Regarding this matter, LawNet would like to answer as follows: 

On April 26, 2024, the Minister of Industry and Trade of Vietnam issued Decision 1003/QD-BCT on the plan for providing legal assistance to small and medium-sized enterprises in 2024.

Specifically, the forms and contents of the key legal assistance for small and medium-sized enterprises in 2024 include: providing information; legal advice for small and medium-sized enterprises; receiving feedback on difficulties and answering legal questions for enterprises; disseminating, promoting, training, and enhancing legal knowledge.

The activities/areas prioritized for legal assistance for small and medium-sized enterprises in 2024 by the Ministry of Industry and Trade are as follows:

- Providing information to enterprises;

- Recognizing and announcing the network of legal consultants in the Industry and Trade sector;

- Receiving and studying feedback from enterprises, proposing amendments and issuance, or submitting to competent authorities for consideration and decision-making on the amendments and issuance of legislative documents;

- Coordinating with the Ministry of Justice in implementing inter-sectoral legal assistance activities for small and medium-sized enterprises under the Program of Inter-sectoral legal assistance for small and medium-sized enterprises in the period of 2021-2025 issued together with Decision 81/QD-TTg 2021 by the Prime Minister.

The list of legal assistance activities for small and medium-sized enterprises in 2024 by the Ministry of Industry and Trade is stated in the Annex attached to Decision 1003/QD-BCT.

The budget for implementing the activities in this Plan is allocated in the budget estimates of agencies and units and is carried out in accordance with the Law on State Budget, the Law on assistance for small and medium-sized enterprises, Decree 55/2019/ND-CP, Decree 80/2021/ND-CP, and Circular 64/2021/TT-BTC guiding the preparation, management, use, and settlement of state budget funds serving legal assistance activities for small and medium-sized enterprises.

The Plan for providing legal assistance to small and medium-sized enterprises in 2024 by the Ministry of Industry and Trade is issued with the aim of actively providing legal information to enterprises; providing legal advice to enterprises; receiving feedback on difficulties and answering legal questions for enterprises; conducting activities of dissemination, promotion, training, and enhancing legal knowledge for enterprises, thereby helping enterprises timely and fully grasp the legal provisions in the state sector of the Ministry of Industry and Trade.

The contents of the Plan for providing legal assistance to small and medium-sized enterprises in 2024 by the Ministry of Industry and Trade must ensure the following requirements:

- The legal assistance for small and medium-sized enterprises is focused, time-bound, and in line with the support objectives and resource balancing capabilities; ensuring transparency, effectiveness, no overlap, duplication, and full implementation of the principles and content of legal assistance for small and medium-sized enterprises as prescribed in the Law on assistance for small and medium-sized enterprises; Decree 55/2019/ND-CP on legal assistance for small and medium-sized enterprises; and Decree 80/2021/ND-CP detailing some articles of the Law on assistance for small and medium-sized enterprises.

- Close integration between the legal assistance for small and medium-sized enterprises and the state management activities of the Ministry of Industry and Trade;

- Strengthening coordination between state management agencies, between state management agencies and representative organizations of enterprises, organizations, and individuals providing legal assistance services for small and medium-sized enterprises in organizing legal assistance activities for small and medium-sized enterprises.

More details can be found in Decision 1003/QD-BCT, which comes into force from April 26, 2024.
