The Ministry of Transport of Vietnam issued Decision 1808/QD-BGTVT dated December 30, 2022 on the Plan of legal support for small and medium enterprises in 2023.

1. Purpose of legal support for small and medium enterprises in Vietnam

Legal support plan for small and medium enterprises in 2023 with the aim of:

- Provide legal information to businesses; disseminate and foster business law knowledge among enterprise managers; and train professional business law skills.

- Ensure initiative and consistency in the direction, operation, deployment, and coordination of legal support activities for businesses.

- Fully support the basic content of current legal provisions and the application of legal documents in production and business activities; create fundamental changes in awareness and compliance with the law; limit risks and legal problems in enterprise business activities.

2. Request legal assistance for small and medium enterprises in Vietnam

- Ensure the correct content and form as prescribed in the Law on providing assistance for small and medium-sized enterprises and Decree 55/2019/ND-CP; at the same time, ensure the good implementation of state management in the field of transportation.

- Integrating and combining legal support activities for small and medium-sized enterprises with activities of propaganda, dissemination, legal education, support, and information provision for enterprises and other state management activities.

- Legal information is accurate, fast, timely and consistent with the requirements of the business.

- Promote communication and strengthen coordination among state agencies; between state agencies and representative organizations of enterprises in organizing legal support activities for small and medium enterprises.

3. Form and content of central legal support

- Support, provide information, and guide the implementation of new regulations in legal documents drafted by the Ministry of Transport and submitted to competent authorities for promulgation or promulgated under its authority in 2022 and 2023 in the following areas:

Railway, road, maritime, aviation, inland waterway... especially regulations related to transportation business; regulations related to capital construction investment under the management of the Ministry of Transport of Vietnam; sanction administrative violations related to the above fields.

- Answering the law for enterprises according to the regulations promulgated together with Decision 1127/QD-BGTVT dated June 22, 2021 and other relevant regulations.

- Receive, study, and consider enterprise recommendations to amend, supplement, and issue new ones, or submit them to a competent state agency for consideration and decision on amendments and supplements, or promulgate new legal documents, in order to create favorable conditions for enterprises to operate and develop in accordance with the Constitution and the law.

4. Organize support implementation

* Departments, Departments under the Ministry

- Deploy and concretize legal contents that need support according to the functions and tasks of agencies and units; select the appropriate form as prescribed in the Law on providing assistance for small and medium-sized enterprises and Decree 55/2019/ND-CP.

- Actively develop a plan to implement the assigned contents in the attached appendix of this plan and other legal support contents according to the characteristics of the agency, the unit shall send it to the Ministry before January 25, 2023 for inspection and monitoring.

- Assume the prime responsibility for, and coordinate with, relevant units under the Ministry and representative organizations of enterprises in providing support to small and medium-sized enterprises with legal contents in the field of state management of agencies and units. taste.

- Guide, monitor, urge, and direct affiliated agencies and units (including universities) to carry out legal support activities for enterprises in their respective management areas in accordance with the plan of legal support for small and medium enterprises in 2023 of the Ministry and Departments.

- Ensure adequate resources to carry out legal support work for small and medium-sized businesses effectively.

- Summarize and report to the ministry (via the Legal Department) on the status and outcomes of the implementation of legal assistance for small and medium-sized businesses by November 30, 2023.

* Legal services

- Monitor and urge the implementation of the Plan of legal support for small and medium enterprises in 2023 of the Ministry of Transport.

- Carry out the task of providing legal support for small and medium enterprises assigned according to the Appendix attached to this Plan.

- Summarize and report to the Ministry of Justice of Vietnam the results of the Ministry of Transport's implementation of legal assistance for small and medium-sized businesses on demand.

* Center for Information and Technology

Maintain a section on legal support for businesses on the Portal of the Ministry of Transport of Vietnam.
