Which provisions of Decree 100 are repealed by the Decree 168 in Vietnam?

Decree 168 provides following regulations:

- Administrative penalties for violations concerning traffic order and safety in the road traffic sector, including: administrative violations; forms, levels of penalties, remedies for each violation; authority to record reports, authority to impose penalties, specific fines according to each position for administrative violations related to traffic order and safety in the road traffic sector;

- The point deduction levels on driving licenses for each administrative violation; procedures, authority for point deductions, and recovery of points on driving licenses to manage adherence to law on road traffic order and safety by drivers.

Administrative violations in other state management fields related to traffic order and safety in the road traffic sector not stipulated in this Decree shall comply with regulations in decrees on administrative penalties in those fields for imposition of penalties.

Decree 168 takes effect from January 1, 2025, and abolishes certain provisions of Decree 100 as follows:

In Clause 8, Article 52 of Decree 168, the following points, clauses, and articles are abolished:

a) Abolishing Clause 1, Article 3;

b) Abolishing points b, e, g, k, l, m, q, r, t, u, v, x, y, Clause 2, Article 4;

c) Abolishing point a, Clause 1, Article 4a;

d) Abolishing Articles 5, 6, 7, 8, 9, 10, 11;

dd) Abolishing Clause 1; point c, Clause 2; points a, dd, Clause 3; points c, d, Clause 5; points e, g, i, Clause 6; Clause 7; point a, Clause 8, Article 12;

e) Abolishing Articles 16, 17, 18, 19, 20, 21, 22;

g) Abolishing point a, Clause 1; Clause 2; points a, b, c, d, dd, e, g, h, k, m, n, Clause 3; Clause 4; points a, b, c, d, dd, e, h, i, k, l, m, o, p, q, Clause 5; Clause 6; Clause 7; Clause 7a, Article 23;

h) Abolishing Clause 1; Clause 2; Clause 3; points b, c, Clause 4; Clause 5; Clause 6; Clause 7; Clause 8; Clause 8a; Clause 9, Article 24;

i) Abolishing Articles 25, 26, 27;

k) Abolishing Clause 1; points e, g, h, Clause 2; point a, Clause 3; points a, e, g, q, Clause 4; Clause 5; points c, dd, e, g, m, o, p, Clause 6; points dd, h, i, Clause 7; points a, b, Clause 8; Clause 9; points c, d, dd, Clause 10; points c, d, i, Clause 11, Article 28;

l) Abolishing Articles 29, 30, 32, 33, 34, 35, 36, 37, 38;

m) Abolishing points a, dd, h, Clause 2; points a, b, c, d, g, h, i, Clause 3; points a, b, c, d, dd, e, i, k, l, Clause 4; points a, b, c, d, dd, g, h, i, k, l, n, p, q, Clause 5; Clause 6; points a, c, d, Clause 8, Article 74;

n) Abolishing points a, b, c, d, dd, e, g, h, k, n, Clause 3; Clause 4; points a, b, c, d, e, Clause 5; Clause 8; Clause 10; Clause 12, Article 80;

o) Abolishing points b, g, h, i, Clause 1; Clause 6, Article 81;

p) Abolishing Clauses 1, 3, Article 82.

Additionally, in Clause 9, Article 52 of Decree 168, certain phrases are omitted from the following points, clauses, and articles in Decree 100:

a) Omitting the phrases "camera," "seat belt," and "journey monitoring device" from point p, Clause 2, Article 4;

b) Omitting the phrase "point a" at point c, Clause 1, Article 4a;

c) Omitting the phrases "Unauthorized use of urban streets, sidewalks for: holding markets; running food service enterprises; displaying, selling goods; repairing vehicles, machinery, equipment; vehicle wash; placing, hanging signs, advertisements;" and "except for the violations stipulated at point d, dd, e, g, Clause 6; Clause 7; point a, Clause 8 of this Article" at point b, Clause 5, Article 12;

d) Omitting the phrases "Article 9, Article 10, Article 11," at point dd, Clause 3, the phrase "Article 32, Article 34;" at point k, Clause 3, the phrase "point a, Clause 2, Article 16; point a, Clause 6, Article 23; point a, Clause 2, Article 32" at Clause 3a and the phrase "Point a, Clause 1," at point g, Clause 4, Article 74.

Thus, Decree 168 does not entirely abolish Decree 100 but instead revises, supplements, and abolishes certain provisions therein.

The provisions not abolished in Decree 100 remain in effect.
