The Ministry of Finance issued Circular 122/2018/TT-BTC on December 14, 2018, detailing specific expenses for the auction sale of confiscated smuggled foreign cigarettes.
Accordingly, the costs related to the auction of confiscated smuggled foreign tobacco as stipulated in Circular 122 include:
- Costs for testing and quality inspection;- Costs for transportation, delivery, and storage from the time of temporary seizure or confiscation decision until the completion of the auction. In case the agency issuing the temporary seizure or confiscation decision has been provided with warehouses, staffing, transportation means, etc., by the State for transporting and storing, these related costs will not be reimbursed for the confiscated smuggled foreign tobacco;- Costs related to determining the starting price for the auction (if any);- Auction service fees (in case of successful auction) or actual reasonable costs (in case of unsuccessful auction) payable to the auction organization conducting the auction. The auction service fee or actual reasonable costs are applied according to the regulations guided by the Ministry of Finance on the framework of auction service fees as stipulated in the Law on Asset Auction;- Other costs directly serving the auction of confiscated smuggled foreign tobacco as per legal regulations.
