Conditions for the operation of public video game service providers in Vietnam from December 25, 2024 will be applied according to the regulations in Decree 147/2024/ND-CP.

The Government of Vietnam issued Decree 147/2024/ND-CP on November 9, 2024, on the management, provision, and use of internet services and online information.

Conditions for operation of public video game service locations in Vietnam from December 25, 2024

Article 62 of Decree 147/2024/ND-CP stipulates the conditions for the operation of public video game service provision locations from December 25, 2024, as follows:

(1) Organizations, enterprises, and individuals are only allowed to establish public video game service provision locations when they possess a certificate of eligibility to operate such locations.

(2) Organizations, enterprises, and individuals are granted a Certificate of Eligibility to Operate Public Video Game Service locations when they meet the following conditions:

- Register a business for the provision of public video game services;

- Have a signboard "Public Video Game Service Provision location" clearly stating the location's name, address, contact phone number, and business registration number. In case the location simultaneously serves as an Internet agency, the content "Internet Agency" should be added. If the location simultaneously serves as a public Internet access location of an enterprise, the content "Public Internet Access location" should be added;

- Have fire prevention and fighting equipment and regulations as per the fire safety and fire prevention requirements of the Ministry of Public Security.

(3) People's Committees of provinces and centrally-run cities:

- Assign district-level People's Committees, towns, and district-level towns to evaluate dossiers, conduct site inspections, issue, amend, supplement, extend, re-issue, and revoke Certificates of Eligibility to operate public video game service provision locations applicable within the locality;

- Direct the Department of Information and Communications to cooperate with district-level People's Committees, towns, and district-level towns in disseminating laws, managing, inspecting, and addressing violations of public Internet access locations and public video game service provision locations within the locality; direct the district-level People's Committees, towns, and district-level towns to publicly list on the agency's and unit's electronic information pages the list of public video game service provision locations granted and revoked Certificates of Eligibility, the list of online games licensed and the list of online games revoked or suspended; notify the service location operators within their locality the list of licensed online games and the list of online games revoked or suspended and report periodically by no later than November 20 each year to the Department of Information and Communications according to Form No. 49 in the Annex issued with Decree 147/2024/ND-CP for the Department of Information and Communications to consolidate and report to the Ministry of Information and Communications (Department of Broadcasting, Television and Electronic Information) no later than November 25 each year.

Form of report submission: Submitted directly or through postal services to the local Department of Information and Communications or submitted via the Department of Information and Communications' online public service system.

In case of submitting through the online public service system, a digital signature is required in accordance with the law on electronic transactions.
