On November 5, 2012, the Government of Vietnam issued Decree 90/2012/ND-CP stipulating the organization and activities of the internal affairs inspection.
Duties and powers of the inspectorate under the Ministry of Home Affairs of Vietnam from January 01, 2013 (Illustrative Image)
Article 4 of Decree 90/2012/ND-CP stipulates that the Inspectorate under the Ministry of Home Affairs of Vietnam shall perform the duties and powers specified in Article 18 of the Law on Inspection and the following duties and powers:
- Guide, inspect, and urge the formulation and implementation of inspection programs and plans of agencies assigned to perform the specialized inspection function under the Ministry of Home Affairs of Vietnam;
- Organize professional training on specialized inspection for Inspectors, individuals assigned to perform the specialized inspection function in internal affairs, and officials working on inspection under the Ministry of Home Affairs of Vietnam;
- Propagate, guide, inspect, and urge agencies and units under the management of the Ministry of Home Affairs of Vietnam to comply with legal regulations on inspection;
- Summarize and draw experience on inspection work within the State management scope of the Ministry of Home Affairs of Vietnam;
- Perform other duties and powers as prescribed by law.
Simultaneously, Article 5 of Decree 75/2012/ND-CP stipulates that the Chief Inspector of the Ministry of Home Affairs of Vietnam shall perform the duties and powers specified in Article 19 of the Law on Inspection and the following duties and powers:
- Report to the Minister of Home Affairs and the Chief Inspector of the Government of Vietnam on inspection work within his/her scope of responsibility;
- Advise and propose to the Minister of Home Affairs on assigning the function of specialized inspection to the Central Emulation and Commendation Board and the Committee for Religious Affairs under the Government of Vietnam;
- Inspect the responsibility of heads of agencies and units under the management of the Ministry of Home Affairs of Vietnam in the implementation of inspection laws;
- Summon officials and public employees from relevant agencies and units to participate in inspection activities;
- Perform other duties and powers as prescribed by law.
