On January 25, 2006, the Government of Vietnam issued Decree 16/2006/ND-CP providing the honor restoration, compensations, supports for agencies, organizations or individuals suffering damage due to their participation in national security protection in Vietnam.
Competence to decide on compensation for property damage due to participation in national security protection in Vietnam (Illustration)
In Article 10 of Decree 16/2006/ND-CP stipulates the competence to decide on compensation for property damage for agencies, organizations, and individuals suffering losses due to participating in national security protection in Vietnam. Specifically:
- The following individuals have the competence to decide on compensation for property damage valued up to under 5,000,000 (five million) VND for entities suffering property damage managed by their units:
- Heads and Deputy Heads of Security Operations Departments under the provincial and municipal police;
- Heads and Deputy Heads of district-level police in charge of security;
- Chief Commanders and Deputy Chief Commanders of the Border Guard at provincial and municipal levels; Heads and Deputy Heads of Security Protection Departments under general departments, military zones, army corps, arms, and branches in the People’s Army.
- The following individuals have the competence to decide on compensation for property damage valued up to under 10,000,000 (ten million) VND for entities suffering property damage managed by their agencies:
- General Directors and Deputy General Directors of the General Department of Security; General Directors and Deputy General Directors of the General Department of Intelligence; Commanders and Deputy Commanders of the Commanding Arm of the Public Security Guard - Ministry of Public Security;
- General Directors and Deputy General Directors of the General Department of Intelligence; Commanders and Deputy Commanders of the Border Guard - Ministry of Defense;
- Directors and Deputy Directors of operational departments under the General Department of Security, and the General Department of Intelligence - Ministry of Public Security;
- Directors and Deputy Directors in charge of security of provincial and municipal police;- Directors and Deputy Directors of operational departments under the General Department of Intelligence - Ministry of Defense;
- Directors and Deputy Directors of the Coast Guard; Directors and Deputy Directors of the Military Security Protection Department under the General Department of Politics; Directors and Deputy Directors of the Reconnaissance Department under the Border Guard Command - Ministry of Defense.
- District-level People's Committee Chairpersons decide compensation for property damage valued up to under 10,000,000 (ten million) VND for entities suffering property damage residing in their localities (in cases where entities suffering property damage are not managed by specialized national security protection agencies).
- Ministers of the Ministry of Public Security and Ministry of Defense decide compensation for property damage valued from 10,000,000 (ten million) VND upwards for entities suffering property damage managed by specialized national security protection agencies.
- Provincial-level People's Committee Chairpersons decide compensation for property damage valued from 10,000,000 (ten million) VND upwards for entities suffering property damage residing in their localities (in cases where entities suffering property damage are not managed by specialized national security protection agencies).
