03 property damages eligible for compensation due to participation in national security protection in Vietnam

The Government of Vietnam issued Decree 16/2006/ND-CP providing the honor restoration, compensations, supports for agencies, organizations or individuals suffering damage due to their participation in national security protection.

Article 8 of Decree 16/2006/ND-CP stipulates the compensation for property damage due to participation in national security protection includes:

  1. Lost property;
  2. Property destroyed or damaged beyond repair;
  3. Reasonable costs for preventing, mitigating, and remedying damage.

Note: The value of the damaged property is determined based on the market price of the property at the local area at the time the damage occurred, minus the depreciation of the property. If the damaged property can be restored, it shall be restored; if it cannot be restored, it shall be eligible for compensation.

Additionally, the Decree stipulates that specialized national security protection agencies at all levels are responsible for reviewing and deciding on compensation for property damage for those under their direct management. If incidents are discovered by other agencies or organizations, those entities are responsible for transferring related documents to the competent specialized national security protection agencies for review and decision on compensation.

Moreover, the District-level or Provincial-level People's Committees (collectively referred to as Provincial-level People's Committees) are responsible for reviewing and deciding on compensation for property damage for individuals whose property was damaged within their locality at the request of the specialized national security protection agencies (in cases where the damaged individuals are not managed by the specialized national security protection agencies).
