Circular 31: Conditions for organizing bidding to select supply units in Vietnam​ (Illustration)

Article 5 Circular 31/2014/TT-BGTVT (amended by Clause 3 Article 1 Circular 38/2017/TT-BGTVT) stipulates the conditions for organizing bidding to select units providing public product and service management and maintenance for road constructions in Vietnam as follows:

The organization of bidding for the production and supply of public utility products and services for the management and maintenance of road constructions is only conducted when the following conditions are met:

- The bidding plan has been approved;

- The bidding documents have been approved;

- Information about the bidding has been published following the provisions of the bidding law;

- Contents, lists of public utility products, and services for the management and maintenance of road constructions, and approved prices: for public utility products and services for regular management and maintenance of road constructions, there must be an approved plan and price; for public utility products and services of a construction nature, there must be technical designs or construction drawing designs (for projects with one-step or two-step design requirements) and approved prices; for public utility products and services of a consulting nature, there must be an outline (task) and approved price; for public utility products and services of a procurement nature, there must be approved contents, lists of goods, and approved prices.

Bidders participating in the bidding process must meet the conditions stipulated by the construction law and the bidding law.
