According to Resolution 09/NQ-CP in 2025, the Government of Vietnam requests the Ministry of Industry and Trade to conduct research on identifying sellers on e-commerce platforms through VneID in Vietnam.

This content is mentioned in Resolution 09/NQ-CP dated January 10, 2025, concerning the Government of Vietnam Conference with localities and the regular Government of Vietnam meeting in December 2024 issued by the Government of Vietnam.

Identification of sellers on e-commerce platforms through VneID in Vietnam

The Government of Vietnam requires the Ministry of Industry and Trade to research and amend under its authority or propose to competent authorities to amend legal documents on e-commerce to identify sellers on e-commerce platforms through VneID.

In addition, regarding the Report on the Implementation Results of the Scheme on the Development of Data Application on Population, Identification, and Electronic Authentication for National Digital Transformation for the period 2022 - 2025, with a vision to 2030, the Government of Vietnam generally agrees with the evaluation of the situation and results of implementing Scheme 06 in Report No. 59/BC-TCTTKDA dated January 7, 2025, from the Task Force for Scheme 06 Implementation, Ministry of Public Security; requiring:

(1) The Ministry of Foreign Affairs to take the lead, coordinate with the Ministry of Public Security, Ministry of Justice, and relevant agencies to research and implement a comprehensive solution to connect administrative procedure systems, systems managed by Vietnamese representative agencies abroad with the National Population Database to share and exploit overseas Vietnamese data sources, serving the issuance of identification numbers and identification cards; connect with the National Immigration Database to serve the issuance of passports for overseas Vietnamese.

(2) The Government Cipher Committee will cooperate with the Ministry of Education and Training to provide digital certificates meeting the requirements of educational institutions as per regulations.

(3) The Government Office to take the lead, cooperate with ministries and agencies:

- Develop business, functional documents of the National Public Service Portal, send to the Ministry of Public Security to develop the National Public Service Portal at the National Data Center as directed by the Prime Minister of the Government of Vietnam in document 8871/VPCP-KSTT dated December 2, 2024.

- Develop the requirements, features, and functions of the Government Reporting Information System, the Government's Directing and Operating Information System, and the Prime Minister's Government, send to the Ministry of Public Security for investment, construction, management of the system, technical operation, ensuring information security and safety of the systems at the National Data Center as directed by the Prime Minister of the Government of Vietnam in Decision No. 1012/QD-TTg dated September 20, 2024, and Directive No. 32/CT-TTg dated September 4, 2024.

Responsibilities of sellers on e-commerce platforms in Vietnam

An e-commerce platform is an e-commerce website that allows merchants, organizations, and individuals who are not the website owner to conduct part or all of the process of buying and selling goods and services on it.

The e-commerce platform as per Decree 52/2013/ND-CP does not include online stock trading websites.

In this context, sellers on e-commerce platforms will have the following responsibilities:

- Fully and accurately provide information stipulated in Article 29 of Decree 52/2013/ND-CP to merchants, organizations providing e-commerce platform services when registering to use the service.

- Fully provide information about goods and services as stipulated from Articles 30 to 34 of Decree 52/2013/ND-CP when selling goods or providing services on the e-commerce platform.

- Ensure the accuracy and truthfulness of information about goods and services provided on the e-commerce platform.

- Comply with the regulations in Section 2, Chapter II of Decree 52/2013/ND-CP when applying the online ordering function on the e-commerce platform.

- Provide business situation information when requested by competent state agencies to serve e-commerce statistics activities.

- Adhere to legal regulations on payment, advertisement, promotion, protection of intellectual property rights, consumer rights, and other related laws when selling goods or providing services on the e-commerce platform.

- Fully fulfill tax obligations as prescribed by law.
