Approval for Reduced Probation Period for Individuals Granted Early Release

Shortening the probation period for individuals granted conditional early release is one of the new policies stipulated in the Law on Execution of Criminal Judgments 2019.

According to Article 64 of the Law on Execution of Criminal Judgments 2019, individuals who are conditionally released on parole can apply for a shortened probation period if they meet the following conditions:

a) Have served half of their probation period;

b) Have made significant progress during their probation period.

Parolees can have their probation period shortened once a year from 03 months to 02 years. In cases where the remaining probation period for a parolee is less than 03 months, the Court may decide to shorten the entire remaining probation period.

Moreover, parolees are eligible for multiple probation period reductions, provided that they have served at least three-quarters of the probation period in reality. Exceptions apply for under-18 individuals, those who have made significant contributions, very elderly individuals, or those suffering from serious illnesses. For these cases, if all conditions are met, the Court may shorten the entire remaining probation period.
