Amendments to the product and service order contract in Vietnam under Circular 31 (Illustrative Image)

In Article 9 of Circular 31/2014/TT-BGTVT, it stipulates the adjustment of order contracts in Vietnam as follows:

Contracts for ordering the production and provision of public services in the management and maintenance of road infrastructure may only be adjusted in the following cases:

- The State adjusts technical-economic norms; prices, unit prices of public products and services;

- The State changes the mechanisms, policies regarding wages, raw material prices, and materials;

- Force majeure reasons as stipulated by law affect the production and provision of public products and services.

Agencies and units directly managing road infrastructure assets shall adjust the order contracts after obtaining written approval from the Directorate for Roads of Vietnam. The approval for contract adjustment must comply with the provisions of Clause 1, Article 9 of Circular 31/2014/TT-BGTVT and within the scope of the expenditure plan from the Central Road Maintenance Fund, as assigned annually by the competent state agency.
