07 Contents of Investigation and Verification of Traffic Accident Circumstances by the Traffic Police

This is a notable content in Circular 63/2020/TT-BCA prescribing the procedures for investigating and resolving road traffic accidents by the Traffic Police force, which takes effect from January 01, 2021.

Article 8 Circular 63/2020/TT-BCA stipulates that when conducting an investigation and clarification of the details of a traffic accident, traffic police officers have the responsibility to clarify the following content:

  1. Whether there is any violation of road traffic order and safety; the course and cause leading to the traffic accident;
  2. Individuals and organizations committing acts of violating road traffic order and safety, faults, personal details of the violators;
  3. Aggravating and mitigating circumstances;
  4. The nature and extent of damage caused by the violation of road traffic order and safety;
  5. Other details that are significant for consideration, decision on punishment, and resolution of the accident;
  6. Inadequacies, loopholes, and shortcomings in traffic organization, traffic infrastructure quality; vehicle management and traffic control;
  7. During the process of consideration and decision on punishment, the competent authority may request an expert appraisal. The request for an expert appraisal shall be conducted in accordance with the laws on expert appraisal.

Note: 

- Assigned traffic police officers arriving at the scene to perform investigation, clarification, and resolution of the traffic accident must draft an Administrative Incident Report according to template No. 02/TNDB issued with this Circular.- Within 24 hours from drafting the administrative incident report, the traffic police officer must report to the competent authority leader to issue a Decision to assign officers to investigate, clarify, resolve the accident, and draft an Investigation and Clarification Plan approved by the competent authority leader;- The drafting of the Administrative Violation Report according to template No. 43/BB-VPHC issued with Circular 07/2019/TT-BCA must be conducted immediately upon identification of the organization or individual committing the violation.
