Guidance on applying the Form of bidding documents on consultancy services under CPTPP and EVFTA Agreements; Addition of the list of veterinary medicines containing narcotics, precursors, etc.; are new remarkable policies which take effect from mid-November, 2022 (from November 11, 2022 to November 20, 2022).
1. Guidance on applying the Form of bidding documents on consultancy service under the CPTPP and EVFTA Agreements
Circular No. 20/2022/TT-BKHDT on guidance on preparation of bidding documents on consultancy services for contract packages regulated by CPTPP, EVFTA and UKVFTA Agreements comes into force from November 20, 2022.
According to the Circular, guidance on applying the Form of bidding documents on consultancy services under the CPTPP and EVFTA Agreements is as follows:
- Regarding a bidding package of consultancy services applying direct contracting, for reference purpose, request for proposals may be made according to regulations of this Circular in accordance with regulations of CPTPP, EVFTA and UKVFTA Agreements.
- If a fixed unit price contract or adjustable unit price contract needs to be applied, the investor and procuring entity must modify regulations of the Form of bidding documents issued together with Circular No. 20/2022/TT-BKHDT in a reasonable manner and in compliance with regulations of CPTPP, EVFTA and UKVFTA Agreements, Decree No. 95/2020/ND-CP and Decree No. 09/2022/ND-CP.
2. Guidance on applying the Form of bidding documents on non-consultancy services under the CPTPP and EVFTA Agreements
Circular No. 21/2022/TT-BKHDT on guidance on preparation of bidding documents on non-consultancy services for contract packages regulated by CPTPP, EVFTA and UKVFTA Agreements comes into force from November 20, 2022.
According to the Circular, guidance on applying the Form of bidding documents on consultancy services under the CPTPP and EVFTA Agreements is as follows:
- Form of bidding documents on non-consultancy services No. 01 (Form 01) applicable to open bidding packages under single-stage and one-envelope bidding procedure;
- Form of bidding documents on non-consultancy services No. 02 (Form 02) applicable to open bidding packages under single-stage and two-envelope bidding procedure;
Regarding a bidding package of non-consultancy services applying direct contracting, for reference purpose, request for proposals may be made according to regulations of Circular No. 21/2022/TT-BKHDT in accordance with regulations of CPTPP, EVFTA and UKVFTA Agreements.
3. Addition of the list of veterinary medicines containing narcotics and precursors
Circular No. 13/2022/TT-BNNPTNT amended the Circular on management of veterinary medicines promulgated by the Minister of Agriculture and Rural Development.
According to the amended Circular, there is an addition of “Article 3a. The list of veterinary medicines containing narcotics and precursors: list of narcotics and precursors which are medicinal ingredients of veterinary medicines containing narcotics and precursors” to Circular No. 12/2020/TT-BNNPTNT.
The list of veterinary medicines containing narcotics and precursors is prescribed in Appendix XI, including:
- The list of veterinary medicines containing narcotics and precursors manufactured in Vietnam with 11 types of medicines such as MULTICID, MULTICID PLUS, A Folaccit C, ALLCID LIQUID, etc.
- The list of imported veterinary medicines containing narcotics and precursors with 12 types of medicines such as Zoletil 50, Productive Acid SE, Intra Aqua Acid Mineral, Stimosol Oral, etc.

4. Items of expenditure on compensation, support and relocation
Circular No. 61/2022/TT-BTC guiding production of estimates, use, payment and finalization of expenditure on compensation, support and relocation in case of land expropriation by the State comes into force from November 20, 2022.
According to the Circular, items of expenditure on compensation, support and relocation include:
- Publicizing policies and regulations on compensation, support, and relocation in case of expropriation by the State and mobilizing relevant entities to implement decisions on land expropriation.
- Covering investigation, surveying, measurement, inventory in accordance with Clause 1 Article 69 of the Law on Land in 2013; etc.
- Producing, appraising, approving, and publicizing solutions for compensation, support, and relocation from calculating indicators, determining relocation, support levels to approving solutions and publicizing solutions for compensation, support, and relocation.
- Paying for compensation, support, and relocation according to solutions for compensation, support, and relocation approved by a competent body as per the law.
- Guiding implementation and dealing with difficulties in organizing implementation of solutions for compensation, support, and relocation approved by a competent body as per the law.
- Renting working office buildings, renting and purchasing machinery and equipment for the purpose of compensation, support, and relocation of authorized organizations and appraising bodies.
- Printing, photocopying documents, incurring office supplies, and communication (post, telephone), fuel and travel.
- Hiring personnel to implement compensation, support, and relocation (if any). The hiring of personnel shall be decided by heads of authorized organizations, regulated under internal spending regulations, and implemented only when authorized organizations lack manpower for implementation. The hired personnel must not carry out the same tasks as personnel of the authorized organizations.
- Incurring other expenses directly related to compensation, support, and relocation.
