Notable new policies of Vietnam to be effective as of the start of December 2024

1. Vietnam's regulations on allowances for people directly carrying out tasks of post-war bomb and mine clearance 

On October 14, 2024, the Prime Minister of Vietnam promulgated Decision No. 16/2024/QD-TTg on regulations on benefits for beneficiaries of state budget salaries and allowances for direct involvement in tasks of surveying and clearing post-war bombs, mines, and explosives.

According to Article 3 of Decision No. 16/2024/QD-TTg, regulations on allowances for people directly post-war bomb and mine clearance are as follows: 

People prescribed in Clause 1 Article 2 of Decision No. 16/2024/QD-TTg, aside from salaries and allowances (if any) and other benefits and policies under the law, shall receive an allowance of 350.000 VND per person per day based on the actual days of direct involvement in tasks at areas for surveying and clearing bombs, mines, and explosives. 

In an actual day of work, if the time of direct involvement in tasks at areas for surveying and clearing bombs, mines, and explosives is under 4 hours, it shall be considered half a day; a day if such time is 4 hours or more.

2. Vietnam’s guidelines for raising capital for overseas petroleum projects and guaranteeing loans for project execution

On October 15, 2024, the Government of Vietnam promulgated Decree No. 132/2024/ND-CP on outward investment in petroleum operations. 

According to Article 17 of Decree No. 132/2024/ND-CP, the guidelines for raising capital for overseas petroleum projects and guaranteeing loans for project execution shall be carried out as follows: 

- A Vietnamese investor may authorize the operating company to raise capital from financial institutions and credit institutions (both domestic and foreign) in order to execute their overseas petroleum project corresponding to the participation ratio of such investor in the project in accordance with relevant regulations of law.

-  In the case of an overseas petroleum project for which an operating company is established and where the financial institution or credit institution requires a pledge or mortgage of the project assets for a loan, the investor reserves the right to initiate legal procedures so as for the operating company to obtain such loans.

- If a financial institution or credit institution requires a guarantee from the investors, a Vietnamese investor shall provide a guarantee corresponding to such investor's participation investment ratio in the project in accordance with relevant regulations of law.

3. Methods of intercepting and accompanying aircraft violating Vietnam’s airspace 

On October 24, 2024, the Government of Vietnam promulgated Decree No. 139/2024/ND-CP on intercepting, accompanying, and forcing aircraft that violate Vietnam’s airspace to land at airports and aerodromes.

Aircraft intercepting or accompanying aircraft that violate Vietnam’s airspace shall comply with the methods specified in Article 6 of Decree No. 139/2024/ND-CP as follows: 

- Aircraft shall intercept or accompany violating aircraft from the rear left or right in conformity with conditions for mobility and observation; then set an appropriate speed and distance to ensure safety and emit symbols, signals, and actions while ensuring that the pilots (crew) of violating aircraft can receive the symbols, signals, and actions from intercepting or accompanying aircraft. 

- After violating aircraft receive the necessary information and stop their acts of violation, intercepting or accompanying aircraft shall exit the area.

4. Vietnam’s amendments to codes of grades of professional titles of vocational education public employees 

On October 25, 2024, the Minister of Labor – War Invalids and Social Affairs of Vietnam promulgated Circular No. 10/2024/TT-BLDTBXH on amendments to Circular No. 07/2023/TT-BLDTBXH on professional codes and standards; salary classification and promotion of vocational education public employees. 

Codes grades of professional titles of vocational education public employees are amended under Circular No. 10/2024/TT-BLDTBXH as follows; 

- Codes of professional titles of vocational education lecturers 

+ Superior vocational education lecturer (grade I) - Code: V.09.02.01;

+ Principal vocational education lecturer (grade II) - Code: V.09.02.02;

+ Theoretical vocational education lecturer (grade III) - Code: V.09.02.03;

+ Practical vocational education lecturer (grade III) - Code: V.09.02.04;

- Codes of professional titles of vocational education teachers

+ Superior vocational education teacher (grade I) - Code: V.09.02.05;

+ Principal vocational education teacher (grade II) - Code: V.09.02.06;

+ Theoretical vocational education teacher (grade III) - Code: V.09.02.07;

+ Practical vocational education teacher (grade III) - Code: V.09.02.08;

+ Vocational education teacher (grade IV) - Code: V.09.02.09.
