New remarkable Vietnamese policies to be effective from the middle of October 2022

1. Entities eligible to be granted access to eID accounts in Vietnam 

This is the content in Decree No. 59/2022/ND-CP dated September 05, 2022 on electronic identification and authentication, which comes into force from October 20, 2022. 

To be specific, Article 11 of Decree No. 59/2022/ND-CP prescribes entities eligible to be granted access to eID accounts including:

- Vietnamese citizens who are 14 years of age or older; Vietnamese citizens who are under 14 years of age or wards may share the same eID accounts with their parents or guardians.

- Foreigners aged 14 years or older who enter in Vietnam; foreigners who are under 14 years of age or wards may share the same eID accounts with their parents or guardians.

- Agencies or non-person entities that are founded or successfully register their operation in Vietnam.

There are two levels of an eID account:

- The level-1 eID account of Vietnamese citizens shall contain the data specified in clause 1 and point a of clause 2 of Article 7 of Decree No. 59/2022/ND-CP. 

The level -1 eID account of foreigners shall contain the data specified in clause 1 and point a of clause 2 of Article 8 of Decree No. 59/2022/ND-CP.

- The level-2 eID account of individuals shall contain the data specified in Article 7 or Article 8 of Decree No. 59/2022/ND-CP.

- The eID account of non-person entities containing the data specified in Article 9 of Decree No. 59/2022/ND-CP is classified as the level-2 eID account.

2. Annulment of requirements for foreign language certificates and computer science certificates for archivist employees in Vietnam

The Minister of Domestic Affairs promulgated Circular No. 07/2022/TT-BNV dated August 31, 2022 on job titles, codes and standards for the titles, organization of examinations, consideration for promotion, appointment and salary placement of public employees specialized in archives. 

According to the Circular, only main archivist employees (Code: V.01.02.01) and archivist employees (code: V.01.02.02) must have skills in using information technology, managing databases and using foreign languages (or ethnic languages for public employees working in ethnic minority areas) according to requirements of their job application.  

(In comparison with the Circular No. 07/2022/TT-BNV, Circular No. 13/2014/TT-BNV provides for requirements for the main archivist employees:

- Possessing level-3 foreign language certificates (or equivalent certificates) of the Vietnam Foreign Language Competency Framework according to regulations in Circular No. 01/2014/TT-BGDDT;

- Possessing computer science certificates with qualifications meeting basic standards of information technology skills according to regulations in Circular No. 03/2014/TT-BTTTT.

Requirements for the archivist employees:

- Possessing level-2 foreign language certificates (or equivalent certificates) of the Vietnam Foreign Language Competency Framework according to regulations in Circular No. 01/2014/TT-BGDDT;

- Possessing computer science certificates with qualifications meeting basic standards of information technology skills according to regulations in Circular No. 03/2014/TT-BTTTT.

Circular No. 07/2022/TT-BNV comes into force from October 15, 2022 and replaces Circular No. 13/2014/TT-BNV dated October 31, 2014 and Circular No. 08/2015/TT-BNV dated December 28, 2015.  

3. 08 methods for providing career consulting for students of vocational schools in Vietnam

The Minister of Labor, War Invalids and Social Affairs promulgated Circular No. 14/2022/TT-BLDTBXH, which comes into force from October 15, 2022, prescribing provision of career and job consulting and start-up support for students at vocational education and training institutions.

08 methods for providing career consulting include:

- Organizing career consulting and orientation programs, itineraries and days for learners.

- Organizing career consulting and orientation seminars, conferences and forums.

- Providing training and access to knowledge and skills for learners through club, team and group activities; extracurricular activities, experiences and exchanges at vocational education and training institutions and employers.

- Organizing competitions to learn about the world of careers and career consulting through career consulting classes and programs.

- Providing career information and career consulting for learners through video clips and images; through documents, publications and media.

- Organizing training, refresher training and professional training courses to develop competence of personnel in charge of providing vocational education and training consulting.

- Cooperating with Ho Chi Minh Communist Youth Union (HCYU) and associations in providing career consulting to HCYU members, young people and students.

- Other methods prescribed by regulations of law.

4. Addition of drugs for which marketing applications are quickly validated in Vietnam

This is the content in Circular No. 08/2022/TT-BYT dated September 05, 2022 on marketing authorization of drugs and medicinal ingredients promulgated by the Minister of Health of Vietnam.

To be specific, a marketing application shall be eligible for quick validation procedures if any of the following requirements is met:

- Rare drugs;

- Drugs serving needs for national defense and security, epidemic control or disaster relief.

- Domestic drugs that are manufactured by production lines that satisfy GMP, GMP-EU, GMP-PIC/S standards and equivalent standards within 18 months from the issuance date of the GMP certificate.

- Vaccines that are approved by WHO; vaccines used for national expanded immunization programs.

- Specialty drugs, drugs with special dosage forms where not more than 02 similar drugs have a marketing authorization when the application is submitted, including:

+ Antineoplastic drugs;

+ Next-gen antiviral drugs;

+ Next-gen antibiotics;

+ Drugs for treatment of haemorrhagic fever, tuberculosis, malaria;

+ Immunosuppressants in organ transplantation.  (New content)

-New antineoplastic drugs, next-gen antiviral drugs, next-gen antibiotics, biologicals.

- Proprietary drugs that are manufactured in Vietnam under a processing agreement or technology transfer agreement

- Drugs of which the manufacturer changes leading to reissuance of a new marketing authorization according to point b clause 2 Article 55 of the Law on Pharmacy. (New content)

Circular No. 08/2022/TT-BYT comes into force from October 20, 2022 and replaces Circular No. 32/2018/TT-BYT.
