Vietnam: Officials and public employees must immediately do the following 03 things in December 2020

1. Officials and public employees must declare the Curriculum Vitae supplement in December

According to the Official Dispatch No. 4547/LĐTBXH-TCCB of the Ministry of Labor, War Invalids and Social Affairs of Vietnam in 2020, in December of each year, officials, public employees and employees must declare a curriculum vitae supplement form with information arising or changing related to themselves, family and social relations during the year.

Accordingly, officials, public employees and employees shall submit to the organization and personnel department of the unit to add to the original dossier a certified true copy within 03 months from the time of supplementation: diplomas, certificates, arising documents in the application file as prescribed (if any). Thus, in December of this year, officials and public employees must make a resume supplement form with information arising or changing related to themselves, family and social relations in 2020 according to the form above. In case there is information arising but officials, public employees and employees do not declare it or make a declaration but it is incomplete, inaccurate or dishonest, the officials, public employees and employees must take personal responsibility before agencies that manage and employ officials, public employees and employees and before the law.

2. Officials and public employees conduct quality assessment and grading before December 15

Specifically, according to Article 20 of the Decree No. 90/2020/NĐ-CP of Vietnam’s Government, the assessment and classification of the quality of public employees is carried out according to each working year. Accordingly, the time for assessing and classifying the quality of officials and public employees is conducted before December 15 of each year, before carrying out the assessment and classification of party members' quality and summarizing the work of annual evaluation, emulation and commendation of agencies, organizations and units. Especially, for public non-business units operating in the fields of education, training and a number of other fields with the end of the working year before December of each year, the head of the public non-business unit shall decide the time to evaluate and classify the quality of public employees. Forms for classification and evaluation of officials and public employees at the end of 2020 include:

Thus, before December 15, 2020, officials and public employees must complete the assessment and classification of the quality of officials and public employees. Concurrently, the results of assessment and classification of the quality of officials and public employees are the basis for the arrangement, use, training, retraining, promotion or promotion of professional titles, planning, appointing, dismissing, transferring, rotating, seconding, rewarding, disciplining, evaluating and ranking the quality of party members and implementing other policies towards officials and public employees.

3. Officials and public employees shall make annual declaration of assets and income

According to Clause 3 Article 36 of the Law on Anti-corruption 2018 of Vietnam, annual declaration shall be made by:

- Holders of positions of directors of provincial departments and above. Declaration must be done annually by December 31;

- Persons other than those mentioned above in charge of official management, management of public funds, public property or public investment, or have influence over the operation of other entities as prescribed by the Government. Declaration must be done annually by December 31.

In order to guide annual declaration of assets and income, according to Article 10 of the Decree No. 130/2020/NĐ-CP of Vietnam’s Government (effective from December 20, 2020), persons in charge of official management, management of public funds, public property or public investment, or have influence over the operation of other entities are obliged to make declarations of assets and income, including:

- Following officer titles and ranks: Enforcement officers; Investigators; Accountants; Rangers; Procurators; Banking procurators; Market controllers; Auditors; Examiners of the Communist Party; Customs examiners; Tax examiners; Inspectors; Judges.

- Persons holding managerial positions from deputies and equivalent to higher positions operating in fields defined under Annex III attached to the Decree No. 130/2020/NĐ-CP.

- Representatives of state capital in enterprises.

Thus, based on the above provisions, before December 31, 2020, officials and public employees of the above-mentioned subjects are required to make annual declaration of assets and income.
