Hanoi: New contents specified in Guideline 01 of 2016 on the implementation of the Charter of the Communist Party of Vietnam

On September 20, 2016, the Central Executive Committee issued Guidance 01-HD/TW on specific issues regarding the implementation of the Charter of the Communist Party of Vietnam. This Guidance supersedes Guidance 01-HD/TW on the implementation of the Charter of the Communist Party of Vietnam dated January 5, 2012. Below are the new contents specified in Guideline 01 of 2016.

1 Regarding educational level (Section 1.2)

- Persons joining the Communist Party of Vietnam living in mountainous areas, border areas, islands, areas of ethnic minorities, and particularly disadvantaged areas or fishermen who regularly work offshore, who do not meet the requirements stated in Point 1, Regulation No. 29-QD/TW, July 25, 2016, of the CPV central committee of the XIIth term on the implementation of the Charter of the Communist Party of Vietnam, must have a minimum educational level of having completed primary school.

- The educational level of persons joining the Communist Party of Vietnam who are village elders, village chiefs, reputable persons living in mountainous areas, border areas, islands, areas of ethnic minorities and particularly disadvantaged areas or fishermen who regularly work offshore must be at least able to read and write in the national language, and must have written approval from the CPV central committee's standing committee before the competent CPV committee issues the decision for admission.

- Persons joining the Communist Party of Vietnam living in remote, mountainous, border, island areas, and disadvantaged areas who do not meet the requirements stated in Point 1, Regulation No. 45-QD/TW, November 1, 2011, of the CPV central committee (hereinafter referred to as Regulation 45-QD/TW) must have a minimum educational level of having completed primary school.

- The educational level of persons joining the Communist Party of Vietnam who are village elders, village chiefs, and reputable persons living in remote, mountainous, and particularly disadvantaged areas must be at least able to read and write in the national language and must have written approval from the CPV central committee's standing committee before the competent CPV committee issues the decision for admission.

2 Background verification (Section 3.4.c)

Replace the phrase “suspected” with “unclear”. To be specific:

In cases where there is an "unclear" political background, the individual must undergo verification by the responsible security agency monitoring the organization.

In cases where there are suspicions regarding political background, the individual must undergo verification by the security agency within the country.

Resolution of recommendations from the Ho Chi Minh Communist Youth Union

(Section 3.6 and Section 5.4.a)

In addition to the stipulated responsibilities of the executive committee of the Ho Chi Minh Communist Youth Union, additional responsibilities are included for the “grassroots youth union collective”. Only the responsibility of the grassroots executive committee of the Ho Chi Minh Communist Youth Union in issuing recommendations for Youth Union members to join the Communist Party of Vietnam is mentioned.

Review and admission of communist party members for those changing work or residence locations

(Section 3.9)

The regulations related to the authority to admit persons into the Communist Party of Vietnam include additional specifics: “the competent authority to admit communist party members (authorized CPV committee, authorized standing committee of the district CPV committee, and equivalent bodies)”. The regulations related to the authority to admit persons into the Communist Party of Vietnam only generally state “the competent authority”.

Assignment of communist party members to monitor and assist reserve communist party members

(Section 3.10)

reserve communist party members transferring party activities (official or provisional) to new work or study locations or new residence must have the CPV cell or grassroots CPV committee at the original location provide comments in the reserve communist party member's self-assessment report and attach a review report on the reserve communist party member from the official communist party member assigned to assist, so the communist party member can report to the CPV committee at the new location to assign an official communist party member for ongoing monitoring and assistance.
 

- The official communist party member monitoring and assisting the reserve communist party member before transferring party activities to another organization must send a review report on the reserve communist party member. The cell assigns another official communist party member to continue monitoring and assisting the reserve communist party member.

Issuance and management of communist party member cards

(Section 7)

Additional content in (Section 7.1.c): “communist party members expelled, removed, or otherwise excluded from the Communist Party of Vietnam, the CPV cell is responsible for collecting the communist party member card and submitting it to the supervisory CPV committee”.

Modification of the content:
communist party members or organizations discovering improper use of communist party member cards, loss or theft of communist party member cards, or counterfeiting must promptly report to the CPV committee.

7 Resolution of changes in name and date of birth


(Section 9)
Effective from August 18, 2016, adjustments to communist party members' age will not be considered; the age of communist party members will be determined according to the age declared in the original communist party member profile when admitted to the Communist Party of Vietnam.

- In cases where communist party members need to change their date of birth from what has been declared in their communist party member profile, they must follow these steps:

+ communist party members must submit a request to the grassroots CPV committee and related documents regarding their date of birth.

+ The grassroots CPV committee reviews and, if agreed, requests the supervisory CPV committee to consider and decide.

+ The supervisory CPV committee resolves changes in the date of birth of communist party members according to the principles:

The age of the communist party member is determined according to the original birth certificate; if there is no original birth certificate, the age is determined based on the profile declared when joining the Communist Party of Vietnam.

If there are grounds to affirm that when joining the Communist Party of Vietnam, the profile is incorrectly declared, other related legal documents according to the regulations on civil registration and management will be used; changes must be approved by the competent CPV committee.

Removal of communist party members from the communist party membership list

(Section 11.1)

Communist party members must write a self-assessment report and conduct a self-assessment before the CPV cell. If the CPV cell requests the self-assessment report three times but the communist party member does not write the report or does not attend the self-assessment meeting, the CPV cell will still review and handle the case of that communist party member.

In cases where the communist party member deliberately avoids writing the self-assessment report as required by the CPV cell, the CPV cell will promptly initiate the process to propose the removal of that communist party member.

Communist party members must write a self-assessment report and conduct a self-assessment before the CPV cell. If the CPV cell requests the self-assessment report three times but the communist party member does not write the report or does not attend the self-assessment meeting, the CPV cell will still review and handle the case of that communist party member.

Appointing additional or supplemental CPV committee members, standing committee members

(Section 15)

Modifications and supplements:
“Those comrades introduced by the congress or the meeting of the CPV central committee into the list for election to the CPV committee, standing committee but gained no more than 50% of the votes, the evaluation and consideration of credibility, capacity, specific structure for supplemental appointment to the CPV committee, the standing committee will be conducted at least 12 months after the congress or meeting of CPV central committee, and must be agreed upon by more than half of the current committee members.”

Section 15.3


“Superior Communist Party of Vietnam committees authorized to form advisory and working bodies with specialized staff. For the CPV committee with fewer than 1,000 members, the specialized staff for advisory bodies will not exceed 3 persons; for the CPV committee with more than 1,000 members, not more than 5 persons; additional staff will be evaluated and decided by the superior CPV committee.

Any requirement exceeding the above staff numbers must have written approval from the Central Organization Committee.”

10 Establishment of CPV committees under the provincial CPV committee, municipal CPV committee (Section 16)

Newly supplemented content specifying the implementation of the Charter of the Communist Party of Vietnam:

The establishment and dissolution of CPV committees under the provincial CPV committee, municipal CPV committee are decided by the provincial CPV committee, municipal CPV committee, upon approval from the Party Secretariat.
