When are teachers in Vietnam eligible for an early salary raise?

Based on Clause 2, Article 3 of Circular 08/2013/TT-BNV regarding early salary raise policies:

Early Salary Raise Policy

  1. The early salary raise policy for officials, public employees, and workers who have announced retirement:

Officials, public employees, and workers who have announced retirement, if during the rank retention period meet the two criteria stipulated in Clause 2, Article 2 of this Circular, have not reached the final salary grade in their rank or title, and from the announcement date to the retirement date is less than 12 months to be eligible for a regular salary raise, shall be entitled to one salary grade increase 12 months ahead of the scheduled time as per Point a, Clause 1, Article 2 of this Circular.

Thus, teachers are eligible for an early salary raise if they have not reached the final salary grade in their rank or title, and in the case where from the date of the retirement announcement to the retirement date is less than 12 months to be eligible for a regular salary raise.

If they are at the final salary grade frame, they do not fall under categories eligible for an early salary raise upon retirement announcement.

Which cases are counted towards the time for regular salary raise for teachers in Vietnam?

Based on Point b, Clause 1, Article 2 of Circular 08/2013/TT-BNV (supplemented by Clause 2, Article 1 of Circular 03/2021/TT-BNV):

Regular Salary Raise Policy

Those stipulated in Clause 1, Article 1 of this Circular, if they have not reached the final salary grade in their rank (hereinafter referred to as the rank), in the title of public employee, expert title and professional specialization titles of the Judiciary, Procuracy (hereinafter referred to as the title) they currently hold, shall be considered for a regular salary raise upon meeting the time conditions of retaining the rank or title and satisfying the criteria for regular salary raise stipulated in Clause 1 and Clause 2 of this Article during the rank retention period as follows:

  1. Time conditions for retaining the rank or title:

b) Cases counted towards the time for regular salary raise consideration include:

- Time off work with full pay according to labor law regulations;

- Time of maternity leave policy as per social insurance law regulations;

- Accumulated sick leave period, occupational accident, and occupational disease periods with social insurance benefits totaling up to 6 months (within the rank retention period) as regulated by social insurance law;

- Time approved by competent authority to go as experts, study, practice, business, or survey within the country or abroad (including time accompanying spouse under Government of Vietnam policies) while still on the payroll of the agency, unit.

- Time officials, public employees, and workers serve in the military per the Military Service Law.

Thus, the cases counted towards the time for regular salary raise consideration for teachers are:

- Time off work with full pay as per labor law regulations;

- Time of maternity leave policy as per social insurance law regulations;

- Accumulated sick leave period, occupational accident, and occupational disease periods with social insurance benefits totaling up to 6 months (within the rank retention period) as regulated by social insurance law;

- Time officials, public employees, and workers serve in the military per the Military Service Law 2015.

What is the seniority allowance rate for teachers in Vietnam?

Based on Subsection 1.1, Section 3 of Circular 04/2005/TT-BNV (supplemented by Clause 3, Article 2 of Circular 03/2021/TT-BNV) concerning the allowance rate and payment method:

ALLOWANCE RATE AND PAYMENT METHOD

  1. Allowance rate:

1.1. Officials, public employees, and workers meeting the time and criteria for seniority allowance as stipulated in points 1 and 2, Section II of this Circular are entitled to seniority allowance as follows:

a) Officials, public employees, and workers stipulated in item a, point 1.1 of Section II of this Circular, after 3 years (36 months) at the final salary grade in their rank or title, are entitled to a seniority allowance equal to 5% of the salary of the final grade in that rank or title; from the fourth year onward, an additional 1% annually for meeting seniority allowance criteria.

b) Officials, public employees, and workers stipulated in item b, point 1.1 of Section II of this Circular, after 2 years (24 months) at the final salary grade in their rank, are entitled to a seniority allowance equal to 5% of the salary of the final grade in that rank; from the third year onward, an additional 1% annually for meeting seniority allowance criteria.

Thus, according to the above regulations and the salary arrangement for teachers stipulated in Decree 204/2004/ND-CP, the seniority allowance rate for teachers is determined as follows:

- University lecturers, secondary school teachers, high school teachers: receive 5% of the salary of the final grade in their rank or title if after 3 years (36 months) at the final salary grade, and from the fourth year onward, an additional 1% annually.

- Primary school teachers, kindergarten teachers: receive 5% of the salary of the final grade in their rank after 2 years (24 months) at the final salary grade in their rank. From the third year onward, an additional 1% annually.
