When are public primary school teachers in Vietnam forced to resign?
Based on Article 19 of Decree 112/2020/ND-CP, public primary school teachers shall be dismissed if they commit violations falling under one of the following categories:
- Have previously been disciplined in the form of demotion for managing teachers or a warning for non-managerial teachers and commit a repeat offense.
- Commit a first-time violation causing particularly serious consequences as specified in Article 16 of Decree 112/2020/ND-CP.
- Managing teachers who commit a first-time violation causing very serious or particularly serious consequences as specified in Clause 3, Article 17 of Decree 112/2020/ND-CP;
- Use fake or illegal diplomas, certificates, or confirmations to be employed by the school;
- Are drug addicts; in such cases, there must be confirmation from a medical facility or a notification from a competent authority.

What are the duties of public primary school teachers in Vietnam?
Based on Article 27 of the Primary School Charter issued together with Circular 28/2020/TT-BGDDT, public primary school teachers have the following duties:
- Implement the primary education curriculum and the school's educational plan. Proactively execute and be responsible for the educational plan; be autonomous and accountable for performing professional tasks (content, teaching methods, student assessment) and the quality and effectiveness of the education of each student in their class, ensuring compliance with the education program and suitability with the students and specific conditions of the school.
- Participate in the development of the educational plan of the professional group and the school; regularly update sector directives; prepare, organize teaching, and assess students according to regulations; and carry out other professional activities.
- Build friendly, democratic relationships between teachers and students, with parents, and with the community; help students to be proactive, creative, confident, and self-reliant in studying and training.
- Maintain the qualities, honor, and reputation of teachers; act culturally, in solidarity, and aid colleagues; set an example for students; love, treat fairly, and respect students; and protect the legitimate rights and interests of students.
- Perform self-assessment based on teacher professional standards; self-study, self-training to enhance professional competencies; regularly participate in teacher training as required; and share professional knowledge with colleagues both within and outside the school via professional activities and training sessions.
- Apply information technology in teaching, learning, and professional activities; creatively and flexibly create teaching materials.
- Participate in selecting textbooks as regulated; recommend the school provides suitable reference materials and teaching aids to use in teaching.
- Participate in quality education assurance.
- Participate in the compulsory education, universal education, and illiteracy eradication in the local area.
- Coordinate with the Ho Chi Minh Young Pioneers Team, students' families, the community, and relevant social organizations to carry out educational tasks.
- Manage and implement the educational plan at the assigned school point as delegated by the principal.
- Carry out other tasks prescribed by law and assigned by the principal.
* Teachers in charge of class management, in addition to the duties mentioned above, also have the following duties:
- Proactively gather information on each student in the assigned class; develop educational activities that clearly show educational goals, content, and methods, ensuring feasible implementation suitable to the students' characteristics, and practical conditions to promote the progress of both the entire class and individual students.
- Conduct educational activities according to the approved plan and get the principal's approval.
- Closely coordinate with students’ parents or guardians, teachers, team leaders, and relevant social organizations to organize educational activities and support, monitor the learning and training of students in their class; compile assessments of students at the end of the first semester and the academic year; guide students in peer evaluation and recommending rewards; list students recommended for retention; and complete the students' academic records.
- Regularly or spontaneously report the class's situation to the principal.
* Teachers in charge of the Young Pioneers Team are accountable to the principal for constructing and implementing the Ho Chi Minh Young Pioneers Team's activities and the Sao Nhi Dong Ho Chi Minh's activities, contributing to the comprehensive educational goals for students.
What are rights of public primary school teachers in Vietnam?
Based on Article 29 of the Primary School Charter issued together with Circular 28/2020/TT-BGDDT, public primary school teachers have the following rights:
- Receive wages, allowances, subsidies, incentives, and other policies as prescribed; have their professional titles upgraded; be protected in terms of dignity, honor, and health; and enjoy material and spiritual benefits as regulated.
- Autonomously complete professional tasks with support from the professional group and the school in choosing, adjusting educational content; applying forms and methods of education; and assessing students appropriate to the students and specific conditions of the school.
- Be facilitated in training to improve qualifications, professional skills; enjoy salary, allowances as per regulations, and other policies when authorized for training or refresher courses by the competent authority.
- Be rewarded and conferred honor titles and other prestigious awards according to regulations.
- Exercise other rights as prescribed by law.
* Teachers in charge of class management additionally have the following rights:
- Attend classes and other educational activities of the students they manage.
- Participate in meetings of the commendation and reward council and other councils when resolving issues related to the students in their class.
- Attend training sessions and thematic conferences concerning class management.
- Authorize students to take leave for not more than 3 continuous days.
- Have reduced teaching hours per week and other rights as prescribed.
* Teachers in charge of the Young Pioneers Team are entitled to policies as prescribed.
