1. Position and functions of the Intellectual Property Office of Viet Nam

- The Department of Intellectual Property is an organization under the Ministry of Science and Technology with the function of advising and assisting the Minister in unifying state management of intellectual property; directly managing the state, and organizing the implementation of public service activities on industrial property according to the provisions of law.

The Intellectual Property Office of Viet Nam has an international transaction name in English: Intellectual Property Office of Viet Nam (abbreviated as IP Viet Nam).

- The Department of Intellectual Property has legal status, has its own seal, and is allowed to open local and foreign currency accounts at the State Treasury and banks to operate and transact according to the provisions of the law.

The Intellectual Property Office of Viet Nam has its headquarters located in Hanoi.

Public service units under the Department have their own legal status and seal and are allowed to open accounts at the State Treasury and the Bank to operate and transact according to the provisions of law.

The establishment, merger, separation, and dissolution of units under the Department of Intellectual Property are decided by the Minister on the basis of the proposals of the Director of the Department of Intellectual Property and the Director of the Department of Organization and Personnel.

- The Director of the Department of Intellectual Property regulates the functions, tasks, powers, organizational structure, and operations of units under the Department within the scope of their assigned authority according to the provisions of law.

- The Director of the Department of Intellectual Property appoints, dismisses, and appoints heads and deputy heads of units under the Department according to the provisions of the law and decentralizes the management of civil servants and public employees of the Ministry.

3. Working regime of the Intellectual Property Office of Viet Nam

- The Intellectual Property Department is organized and operates under a leadership regime combined with collective discussion.

- The Department of Intellectual Property implements working regulations and working relations with units under the Ministry according to the Ministry's working regulations and other relevant regulations.

- The Department of Intellectual Property is responsible for closely coordinating with relevant agencies, organizations, and individuals outside the Ministry in accordance with regulations when performing assigned functions and tasks.
