1. Organizational Structure of the Intellectual Property Office of Viet Nam in 2024

According to Article 4 of the Regulation issued together with Decision 2525/QD-BKHCN dated September 4, 2018, the organizational structure of the Intellectual Property Office of Viet Nam includes:

* Units assisting the Director General in performing state management functions

- Office of the Department.

- Planning - Finance Department.

- Personnel Department.

- Registration Department.

- Legal and Policy Department.

- International Cooperation Department.

- Enforcement and Complaint Resolution Department.

- Representative Office of the Intellectual Property Office of Viet Nam in Ho Chi Minh City.

- Representative Office of the Intellectual Property Office of Viet Nam in Da Nang City.

The Office of the Department and the Representative Offices have their own seals and are allowed to open accounts at the State Treasury and Banks to operate and transact as prescribed by law.

* Public service providers under the Office

- Patent Examination Center.

- Industrial Design Examination Center.

- Trademark Examination Center.

- Geographical Indication and International Trademark Examination Center.

- Post-Grant Intellectual Property Examination Center.

- Industrial Property Information Center.

- Information Technology Center.

- Research, Training, Support, and Consultancy Center.

Public service providers under the Office as prescribed in clause 2, Article 4 of the Regulation issued together with Decision 2525/QD-BKHCN dated September 4, 2018, have legal status, their own seals, and are allowed to open accounts at the State Treasury and Banks to operate and transact as prescribed by law.

* The establishment, merger, division, separation, and dissolution of units under the Intellectual Property Office of Viet Nam is decided by the Minister based on the proposal of the Director General of the Intellectual Property Office of Viet Nam and the Director of the Personnel Department.

* The Director General of the Intellectual Property Office of Viet Nam prescribes the functions, tasks, powers, organizational structure, and operations of units under the Office within the scope of authority assigned according to the provisions of the law.

* The Director General of the Intellectual Property Office of Viet Nam appoints, removes, and dismisses chiefs, deputy chiefs of units under the Office in accordance with the provisions of the law and the management hierarchy of officials and public employees of the Ministry.

2. Regulations on the leadership of the Intellectual Property Office of Viet Nam

According to Article 3 of the Regulation issued together with Decision 2525/QD-BKHCN dated September 4, 2018, the leadership of the Intellectual Property Office of Viet Nam is regulated as follows:

- The leadership of the Intellectual Property Office of Viet Nam comprises a Director General and no more than 03 Deputy Directors General.

- The Director General is appointed and removed by the Minister of Science and Technology, is responsible to the Minister and the law for the entire operation of the Intellectual Property Office of Viet Nam.

- The Deputy Directors General assist the Director General in leading the office’s work, have decision-making power over assigned tasks, and are responsible to the Director General and the law for the tasks assigned. The Deputy Directors General are appointed by the Minister of Science and Technology based on the Director General's proposal.

- In case the Director General is absent, a Deputy Director General authorized by the Director General will represent and manage the office’s activities.

3. Working regime of the Intellectual Property Office of Viet Nam

According to Article 6 of the Regulation issued together with Decision 2525/QD-BKHCN dated September 4, 2018, the working regime of the Intellectual Property Office of Viet Nam is regulated as follows:

- The Intellectual Property Office of Viet Nam is organized and operates under the regime of the head in combination with collective discussion.

- The Intellectual Property Office of Viet Nam implements a working regime and coordinates work with units under the Ministry according to the Ministry's working regulations and other relevant regulations.

- The Intellectual Property Office of Viet Nam is responsible for closely coordinating with relevant agencies, organizations, and individuals outside the Ministry to effectively implement assigned functions and tasks as prescribed.
