1. What are the regulations on scope of travel services in Vietnam?

The of travel services in Vietnam according to Article 30 of the Law on Tourism 2017 is as follows:

- Provision of domestic tours for domestic tourists.

- Provision of international tours for inbound tourists and outbound tourists.

- The international travel service provider may provide international and domestic tours, except the case prescribed in Clause 4 of Article 30 of the Law on Tourism 2017.

- Foreign-invested providers shall only provide international tours for inbound tourists, unless otherwise prescribed by the treaties to which the Socialist Republic of Vietnam is a signatory.

2. Conditions for provision of travel services in Vietnam

Conditions for provision of travel services in Vietnam according to Article 31 of the Law on Tourism 2017 are as follows:

* A domestic travel service provider must satisfy the following conditions:

- The enterprise is established as prescribed by the law on enterprises;

- The enterprise must make has paid a deposit to a bank;

- The person in charge of provision of travel services holds an associate degree or higher in travel; in case he/she holds an associate degree or higher in another major, a certificate of training in domestic tour operation is required

* An international travel service provider must satisfy the following conditions:

- The enterprise is established as prescribed by the law on enterprises;

- The enterprise has paid a deposit to a bank;

- The person in charge of provision of travel services holds a college degree or higher in travel; in case he/she holds a college degree or higher in another major, a certificate of training in international tour operation is required.

* The enterprise satisfying the conditions set forth in Clause 1 and Clause 2 of Article 31 of the Law on Tourism 2017 shall be issued with a license for provision of domestic tours and a license for provision of international tours respectively.

The fees for assessment and licensing of provision of international tours and domestic tours shall be governed by the law on fees and charges.

- The Government shall elaborate the payment of deposit as prescribed in Point b, Clause 1 and Point b, Clause 2 of Article 31 of the Law on Tourism 2017.

3. Regulations on replacement of the license for provision of tour in Vietnam

Regulations on replacement of the license for provision of tour in Vietnam according to Article 35 of the Law on Tourism 2017 are as follows:

- The enterprise shall apply for replacement of the license for provision of tour in the following cases:

+ Change the business registration certificate or investment registration certificate;

+ Change scope of provision of international tours.

- An application for replacement of the license for provision of tour includes:

+ An application form for replacement of the license for provision of tour according to the form prescribed by the Minister of Culture, Sports and Tourism;

+ The license for provision of tour of the provider;

+ A certified true copy of the business registration certificate or investment registration certificate in any of the cases specified in Point a, Clause 1 of Article 35 of the Law on Tourism 2017; a certificate of deposit payment in conformity with the scope of provision of tour in any of the cases specified in Point b, Clause 1 of Article 35 of the Law on Tourism 2017.

- Procedures for replacement of the license for provision of tour:

+ The provider shall submit 01 application to the licensing authority;

+ Within 05 working days from the day on which a valid application is received, the licensing authority shall be responsible for issuing a new license for provision of tour to the enterprise; in case of refusal, a written response stating reasons thereof must be given;

The General Department of Tourism shall inform the tourism authority of the province where the enterprise is located thereof when issuing a new license for provision of international tours.
