Based on Article 76 and Article 77 of the Housing Law 2023, there are currently 10 categories of individuals eligible to purchase social housing:
- Individuals who have rendered services to the revolution, relatives of martyrs who are entitled to housing improvement support under the Ordinance on Preferential Treatment for Individuals with Revolutionary Services.
- Poor and near-poor households in urban areas.
- Low-income individuals in urban areas.
- Workers and laborers working in enterprises, cooperatives, or federations of cooperatives inside and outside industrial zones.
- Officials and public employees in accordance with the law on officials and public employees.
- Individuals who have returned official duty housing in accordance with clause 4, Article 125 of the Housing Law 2023, except in cases where the housing was retrieved due to violations of the Housing Law 2023.
- Households or individuals whose land is reclaimed and need to evacuate or demolish houses in accordance with the law, and have not been compensated by the State with housing or homestead land.
- Officers, professional soldiers, non-commissioned officers of the people's armed forces, police workers, officials, defense workers and public employees on active duty; individuals working in cipher organizations, or other individuals in cipher organizations receiving state budget salaries working in can buy social housing if they have not received housing support policies for the people's armed forces.
In addition, the following categories are still eligible to purchase social housing in 2025 as determined by the provincial-level People's Committee based on local conditions, including:
- Poor and near-poor households in rural areas.
- Poor and near-poor households in rural areas frequently affected by natural disasters and climate change.
Pursuant to clause 1, Article 48 of Decree 100/2024/ND-CP, individuals specified in clauses 1, 4, 5, 6, 7, and 8 of Article 76 of the Housing Law 2023 can obtain preferential loans to buy social housing if they meet the following conditions:
- Have a source of income and the ability to repay the loan as committed with the Social Policy Bank;
- Have an Application for Loan to purchase social housing;
- Have a Purchase Contract for social housing with the investor as per the regulations of this Decree and housing law;
- Ensure loan collateral with assets formed from the loan according to the law. The Social Policy Bank, investor, and borrower must clearly specify the management and handling methods of the collateral in the tripartite contract.
According to Article 90 of the Housing Law 2023, the management and operation of social housing is regulated as follows:
- For social housing built with public investment capital, the competent authority specified in Article 14 of the Housing Law 2023 decides to select the unit responsible for management and operation in accordance with clause 5, Article 125 of the Housing Law 2023.
For social housing built with union financial resources, the Vietnam General Confederation of Labor decides on the unit responsible for management and operation within authority; in the case of multiple applicants, procurement regulations may be applied to select the management and operation unit.
- For social housing built without using public investment capital or union financial resources, the management and operation are regulated as follows:
(1) For social housing for rent, the project investor is responsible for organizing management and operation or hiring, authorizing a capable unit to manage and operate in accordance with the regulations.
(2) For social housing for rent-to-buy, during the lease-purchase period, the investor manages and operates according to the regulation in (1); after the lessee-purchaser has paid the full lease-purchase price to the investor, management and operation are conducted according to the regulation in (3).
(3) For social housing for sale, individual buyers self-manage and operate if the housing is standalone; in the case of apartments, the management and operation must comply with the apartment management regulations stipulated in the Housing Law 2023.
- Activities related to the management and operation of social housing enjoy preferential mechanisms similar to public utility services.
- The unit managing and operating social housing is entitled to provide other services within the social housing area that are not prohibited by law to reduce the cost of managing and operating housing.
