Regarding this issue, LawNet would like to answer as follows:
The tasks of the Viet Nam Lawyers’ Association are specified in Article 5 of the Charter of the Viet Nam Lawyers’ Association issued with Decision 770/QD-TTg in 2020, including:
- Comply with the Party's views and guidelines, the State's policies and laws, and the Association's Charter.
- Gather, unite, and promote membership; organize and coordinate activities among members in accordance with the principles and purposes of the Association, building a strong Association in politics, ideology, organization, and profession.
- Participate in developing policies, laws, and legal scientific research; participate in social criticism and supervision; and participate in resolving complaints and disputes at the request of state agencies.
- Participate in disseminating and educating the law, raising legal awareness for members, officials, civil servants, public employees, and the People.
- Legal consulting, legal aid, grassroots conciliation, consulting on complaint resolution, legal dispute resolution outside the state mechanism according to the provisions of law.
- Develop and implement programs and projects on dissemination, legal education, and legal aid in accordance with the socialization policy of the Party, State and other programs and projects at the request of State agencies.
- Participate in training and fostering activities; selection of a number of judicial positions and people's jurors; Participate in administrative reform, judicial reform, crime prevention and control activities and other judicial activities according to the provisions of law.
- Coordinate with relevant agencies and organizations to carry out the Association's tasks and fulfill the obligations of members of the Vietnam Fatherland Front.
- Promote international cooperation activities, expand and improve the effectiveness of cooperation activities between the Viet Nam Lawyers’ Association and progressive organizations and jurists of countries in the region and around the world according to regulations of the Law; mobilize Vietnamese jurists residing abroad to unite and contribute to building the country.
Participate in people's foreign affairs in accordance with the Party's guidelines and policies and the State's laws.
- Publishing and distributing books, magazines, and other legal publications to meet the Association's operational requirements according to the provisions of law.
- Develop and implement ethical rules for members of the Viet Nam Lawyers’ Association in accordance with the provisions of the law and the Association's Charter.
- Manage and use the Association's assets and finances according to the provisions of law and the Association's Charter.
- Perform other tasks when requested by competent authorities.
The powers of the Viet Nam Lawyers’ Association are specified in Article 6 of the Charter of the Viet Nam Lawyers’ Association issued with Decision 770/QD-TTg in 2020, including:
- Widely propagate the Association's principles, goals and tasks.
- Represent members in internal and external relationships related to the functions and tasks of the Association; make recommendations to competent state agencies on issues related to the development of the Association and its field of operation; on law construction and enforcement and other related issues.
- Reflect the thoughts and aspirations of Vietnamese lawyers towards the Party and State; training, fostering, and improving legal knowledge and professional ethics for members; Motivate and care about members' interests; protect the legitimate rights and interests of members; Resolve complaints and denunciations of members according to the provisions of law and the Association's Charter.
- Provide services on issues within the Association's field of activities according to the provisions of law.
- Establish organizations and units under the Association according to the provisions of the law and the Association's Charter.
- Raise funds for the Association on the basis of membership fees of members and other legal sources of revenue according to the provisions of law.
- Receive legal funding sources from domestic and foreign organizations and individuals according to the provisions of law.
- Join corresponding international organizations and sign and implement international agreements according to the provisions of law.
