Regarding this issue, LawNet would like to answer as follows:

1. Membership standards of the Viet Nam Lawyers’ Association

Vietnamese citizens with civil act capacity, good moral qualities, a bachelor's degree in law or higher, or a bachelor's degree in another major but who have worked in law for three years or more and agree with the Association's Charter can join the Association.

Vietnamese citizens who do not have the conditions or are not qualified to become official members, agree with the Association's Charter, have contributed to the Association and voluntarily apply to join the Association may be recognized as an honorary member of the Association.

Honorary members enjoy the same rights and obligations as official members of the Association except for the right to vote on the Association's issues and the right to run for office, nominate members of the Association's leadership bodies, leadership positions, and the Association's Inspection Committee.

2. Rights of members of the Viet Nam Lawyers’ Association

The rights of members of the Vietnam Bar Association are specified in Article 8 of the Charter of the Viet Nam Lawyers’ Association issued with Decision 770/QD-TTg in 2020, including:

- Be issued a Membership Card.

- Be provided with information related to the Association's field of activities and participate in activities organized by the Association.

- Be trained and improve your legal knowledge and professional skills.

- Participate in discussions and decide on the Association's working policies according to the Association's regulations.

- Attend the Congress, stand for election, nominate, and be elected to the Association's leadership bodies, leadership positions, and the Association's Inspection Committee according to the provisions of this Charter.

- Introduce new members.

- Rewarded according to the Association's regulations.

- Complain about the Association's decisions, denounce acts that violate the rights and interests of members and the Association's organization according to the law and the Association's Charter.

- To request the Association to protect legitimate rights and interests according to the provisions of the law and this Charter.

- Change the place of Association activities, waive Association activities, apply to leave the Association when deemed unable to continue being a member according to regulations.

3. Duties of members of the Viet Nam Lawyers’ Association

Duties of members of the Vietnam Bar Association are specified in Article 9 of the Charter of the Viet Nam Lawyers’ Association issued with Decision 770/QD-TTg in 2020, including:

- Strictly comply with the Party's guidelines and policies, the State's policies and laws; and the Association's Charter and regulations.

- Participate in activities and activities of the Association; unite and cooperate with other members to build a strong and developed Association.

- Protect the reputation of the Association, do not use the name of the Association in transactional relationships unless assigned in writing by the Association's leaders.

- Carry out tasks assigned by the Association.

- Implement the information and reporting regime according to the Association's regulations.

- Pay membership fees in full and on time according to the Association's regulations.

4. Membership card of Viet Nam Lawyers’ Association

- Membership cards are issued by the Central Vietnam Bar Association to members nationwide.

- Revocation of Membership Card in the following cases:

+ Members are disciplined in the form of expulsion from the Association;

+ Members have a decision to leave the Association;

+ Members do not participate in activities or pay membership fees continuously for two years or more.

- The Central Standing Committee of the Viet Nam Lawyers’ Association regulates the form of Membership Card; and provides specific instructions on the order and procedures for the issuance and revocation of Membership Cards.
