Regarding this issue, LawNet responded as follows:

1. Requirements for vocational training for young people completing military service

Specifically, Article 15 of Decree 61/2015/ND-CP stipulates that young people completing military service are entitled to vocational training support when they fully meet the following conditions:

- They apply for vocational training with a period of 12 month from the date on which they complete their military service, police duties; or programs and projects in terms of socio-economic development;

- They have not received any other support for vocational training funded by government budget from the date on which they complete their military service, police duties; or programs and projects in terms of socio-economic development.

2. Content and level of vocational training support for young people completing military service in Vietnam

Pursuant to Clause 1, Article 3 of Circular 43/2016/TT-BLDTBXH, the content and level of vocational training support for young people completing military service are as follows:

- Young people who need vocational training at elementary level fully satisfy the conditions specified in Article 15 of Decree 61/2015/ND-CP and are granted vocational training cards by competent agencies (hereinafter referred to as the Card), and the vocational education institutions specified in Clause 2, Article 2 of Circular 43/2016/TT-BLDTBXH will receive, organize vocational training at elementary level, and pay for the following support:

+ Expenses for training support specified in Article 10 of Circular 152/2016/TT-BTC;

+ Expenses for food and travel allowances specified at Points b and c, Clause 2, Article 7 of Circular 152/2016/TT-BTC.

Prioritize expenses for training support within the maximum value of the card and use the remaining value of the Card (if any) to support food and travel expenses.

- In case the total expenditure on training support and food and travel expenses exceeds the maximum value of the Card, the learners themselves shall pay the difference in expenses to the vocational education institution. In case the total expenditure on training support, food, and travel expenses is lower than the maximum value of the Card, the state budget shall settle the actual expenditure.

- During the vocational training period, if the youth withdraws from school (does not continue to study until graduation), the vocational education institution makes a record or issues a decision and is entitled to settlement of training support expenses and meal support from the date of the opening of the school year to the date the youth quits school.

3. Application for registration of vocational training at the elementary level via Card for young people completing military service in Vietnam

According to Clause 2, Article 3 of Circular 43/2016/TT-BLDTBXH, within 01 year from the date of being granted the card, the youth chooses a career and a vocational education institution to submit an enrollment application together with the following papers:

- Vocational training card at primary level (original);

- Decision on demobilization (copy) for young people who have completed military service or police service; certificate of participation in volunteer activities (copy) for young people who volunteer to complete the task of implementing socio-economic development programs and projects;

- A written commitment not to receive vocational training support from other vocational training support policies with funding from the state budget from the date of completion of military service, public security service, or the task of implementing socio-economic development programs and projects (The commitment letter according to Appendix No. 01 attached to Circular 43/2016/TT-BLDTBXH).

4. Funding sources to support vocational training for young people completing military service

Funding sources to support vocational training for young people completing military service are specified in Clause 4, Article of Circular 43/2016/TT-BLDTBXH as follows:

- Funding sources to support vocational training at the primary level through Youth Cards are guaranteed by the central and local budgets, and shall be arranged in annual estimates of recurrent expenditures assigned by ministries, branches, and central and local agencies in accordance with the law on the state budget.

- Annually, if there is a shortage of funds from the central budget, the ministries, branches, central agencies, and localities shall report it to the Ministry of Finance for additional funding for implementation. At the end of the budget year, the unused portion of funds guaranteed by the central budget (if any) shall be carried over to the next year for further implementation and shall not be used for other purposes.

In 2016, ministries, branches, central agencies, and localities shall arrange funding sources within the assigned estimate for implementation. In case of difficulties, report them to the Ministry of Finance.
