On September 30, 2024, the Government of Vietnam issued Decree 118/2024/ND-CP detailing certain provisions for the implementation of the Law on Execution of Criminal Judgments 2019.

Regulations on regime for vocational training of inmates in Vietnam from November 15, 2024

Article 15 of Decree 118/2024/ND-CP stipulates the regime for vocational training of inmates in Vietnam as follows:

- Based on the abilities, cultural level, health, gender of inmates, the labor market, specific conditions, and potential cooperation with organizations and individuals, prisons organize teaching of basic and simple vocations or apprenticeship enhancement for inmates. Prisons cooperate with vocational education institutions or vocational training centers (having legal status according to the law) to organize vocational training, skills enhancement, and mentorship for inmates.

- Inmates under 18, young inmates up to 30 years old without prior vocation, inmates with sentences under 5 years, and those nearing the completion of their sentence are prioritized for vocational training and skills enhancement. Each inmate is allowed to learn only one vocation.

- Vocational training plans and programs for inmates in Vietnam.

+ Based on capital sources, annual plans, prisons develop their vocational training plans and submit them to the Criminal Judgment Execution Management Agency under the Ministry of Public Security (for prisons managed by the Ministry of Public Security) and the Criminal Judgment Execution Management Agency under the Ministry of National Defense (for prisons managed by the Ministry of National Defense) for approval. The vocational training plan contents include legal basis, training fields, number of classes, number of inmate trainees, location, training format, level and expected training duration, estimated vocational training expenses, and funding sources. Inmates are trained at the primary level or undergo regular training;

+ Primary level vocational program for inmates: The training program is a minimum of 300 hours with 3 units including vocational knowledge, practical skills, and attitudes toward the learned vocation, with a duration between 3 months to under 1 year. The content and structure of the primary level training program must ensure scientific, systematic, practical terminology, being consistent, understandable, and aligned with the primary level training objectives per Clause 1 and Point a, Clause 2, Article 4 of the Vocational Education Law 2014, suitable with the national vocational qualification framework and standards;

+ Regular vocational training programs for inmates: Inmates are trained through mentorship, coaching, practicing vocation, with hands-on practice ranging from 100 to under 300 hours and course duration of under 3 months. Regular training programs ensure learners gain the capacity to perform vocational work, enhance labor productivity, allow inmates to self-perform simple tasks, one or some parts of a vocation, and acquire awareness of labor safety and hygiene;

+ The vocational training program content is evaluated by the Training Program Evaluation Council and approved and issued by the head of the training institution.

- The Criminal Judgment Execution Management Agency under the Ministry of Public Security and the Ministry of National Defense, based on actual conditions and the labor market, stipulate the vocational training fields for inmates.

More details can be found in Decree 118/2024/ND-CP, which comes into force in Vietnam from November 15, 2024, replacing Decree 133/2020/ND-CP detailing certain provisions for the implementation of the Law on Execution of Criminal Judgments 2019.
