Regulations on the procedures of revising and updating cadastral records in Vietnam

From August 1, 2024, the procedures of revising and updating cadastral records in Vietnam will be carried out in accordance with the provisions of Circular 10/2024/TT-BTNMT.

According to Article 22 Circular 10/2024/TT-BTNMT stipulates the procedures for revising and updating cadastral records in Vietnam as follows:

(1) In cases of regular registration of land, property associated with land, including the first-time registration and change registration, the regularization and updating of land records shall be carried out as follows:

- Where a land database has been established, the regularization and updating of digital land records shall be conducted in conjunction with the registration procedures as follows:

+ Update land registration information, property associated with land, scan documents on land use rights, ownership of assets associated with land, land allocation documents for management (if any) after receiving a complete and consistent dossier as prescribed;

+ Update the results of the regularization of cadastral maps or cadastral map parcels measurement extracts and land inventory sources in cases requiring cadastral measurements;

+ Update the results of dossier inspection after completing the inspection according to the authority;

+ Update information on financial obligations of land users after receiving the proof of financial obligations payment or documents from the competent authority on debt acknowledgement or financial obligation exemption/reduction according to regulations;

+ Scan and input additional information into the cadastral record related to issued Certificates or confirmed changes; in the case of first-time registration of land, property associated with land without the need, not qualified for, or not eligible for the Certificate, input additional information as prescribed for cases without the Certificate;

+ Check the regularization and updating; extract into the cadastral book and approve the established or regularized page of the cadastral book;

- Where a land database has not been established, the regularization and updating of land records shall be carried out as follows:

+ In cases of first-time registration, Certificate issuance, or change registration, then regularize, update the land records and copy the Certificate for archiving before handing it to the grantee;

+ In cases of first-time land registration without qualifying for the Certificate or without the need for the Certificate, regularize, update the land records after receiving the dossiers from the competent authority;

+ In cases of land registration where the State allocates the land for management, regularize, update the land records after completing the dossier inspection according to authority or after receiving the dossiers from the competent authority.

(2) In the case of land recovery, based on the completed land recovery dossier (land handed over on site), regularize the land records in the following order:

- Regularize the cadastral map or cadastral map parcel measurement extract and regularize the land inventory sources against the cases of partial parcel recovery by land area handed over on site;

- Confirm the recovery on the issued Certificate for archiving; in the case of partial parcel recovery, scan or copy the Certificate with recovery confirmation for archiving;

- Regularize and update the cadastral book. Where a land database has been established, check the information update; extract into the cadastral book and approve the regularized page of the cadastral book.

(3) In cases of land allocation, land lease (including through land use rights auction, project bidding involving land use), regularize, update land records after handing over the land on site in the following order:

- Inspect, regularize the cadastral map or cadastral map parcel measurement extract and the land inventory sources to be consistent with the land handover status on site;

- Update registration information from the completed land allocation or lease dossiers into the cadastral book;

- Scan or copy and input additional scanned information into the land records about the signed Certificate before handing it to the grantee;

- Check the information update, extract into the cadastral book, and approve the established page of the cadastral book for places where the land database has been established.

(4) In cases of reissuing the Certificate due to loss, regularize, update the land records associated with the procedure process as follows:

- Update the information on the lost Certificate status into the cadastral book after reissuing the Certificate;

- Scan or copy and input additional information into the land records about the decision to cancel the lost Certificate and reissue the Certificate before handing it to the grantee;

- Check the information update, extract into the cadastral book, and approve the regularized page of the cadastral book for places where the land database has been established.

(5) In cases of reissuing the Certificate or correcting the issued Certificate, regularize, update the land records as follows:

- Where a land database has been established, regularize, update the land records related to the procedure process in the following order:

+ Input registration information for reissuing or correcting the issued Certificate; scan the issued Certificate after receiving the complete and consistent dossier as prescribed for cases not yet scanned;

+ Input the results of dossier inspection after completing the inspection according to authority;

+ Scan and input additional information on issuing or correcting the Certificate before handing it to the grantee;

+ Check the information update, extract into the cadastral book, and approve the established page of the cadastral book;

- Where a land database has not been established, perform the above tasks after being signed for reissuance or correction by the competent authority before handing it to the grantee.
