Regarding this issue, LawNet responded as follows:

1. What is a semi-boarding public school for ethnic minorities?

According to Clause 1, Article 3 of the Regulations issued together with Circular 03/2023/TT-BGDDT, a semi-boarding public school for ethnic minorities is a school established by the State for ethnic minority students and students from families who permanently settle in areas with extremely difficult socio-economic conditions in order to contribute to the realization of equality in access to education and the goal of sustainable development in the field of education in ethnic minority and mountainous areas.

2. Regulations on the percentage of semi-boarding students at the semi-boarding public schools for ethnic minorities in Vietnam

According to Clause 2, Article 3 of the Regulation promulgated together with Circular 03/2023/TT-BGDDT, the percentage of semi-boarding students at a semi-boarding public school who are ethnic minorities is prescribed as follows:

- For ethnic minority semi-boarding primary schools: there are at least 20% of semi-boarding students;

- For ethnic minority semi-boarding lower secondary schools: there are at least 45% of semi-boarding students;

- For ethnic minority semi-boarding primary and upper secondary schools: there are at least 32.5% day-boarding students, or at least 20% day-boarding elementary school students, and 45% day-boarding junior public school students.

In addition, the percentage of students who are ethnic minorities at a semi-boarding public school for ethnic minorities must ensure that at least 50% of the total number of students in the whole school are ethnic minorities.

3. Conditions for students to attend semi-boarding public schools for ethnic minorities in Vietnam

Conditions for students to attend semi-boarding public schools for ethnic minorities are specified in Article 2 of the Regulation promulgated together with Circular 03/2023/TT-BGDDT as follows:

- Conditions for students to attend a semi-boarding public school for ethnic minorities: students of primary and secondary school age are in the enrollment area of the school according to the regulations of the competent authority.

- Day-boarding students: Students who are eligible for support policies approved by competent authorities according to the Government's regulations, because they cannot go to school or school sites and return home during the day.

4. Duties and powers of the semi-boarding public school for ethnic minorities in Vietnam

A semi-boarding public school  for ethnic minorities shall perform the tasks and powers in accordance with the current regulations in the charter of the public school and the following tasks and powers:

- Organizing the approval of semi-boarding students according to the Government's regulations.

- Organizing the management, education, nurturing, and care of part-boarding students.

- Organizing educational activities according to the provisions of Clause 2, Article 11 of the Regulation promulgated together with  Circular 03/2023/TT-BGDDT.

- Implementing regimes and policies for managers, teachers, employees, and students according to the State's regulations.

- Carrying out socialization to serve the educational activities of the school.

- Coordinating with families and society in managing, educating, nurturing, and taking care of semi-boarding students.

5. Organizational structure of a semi-boarding public school for ethnic minorities in Vietnam

According to Article 6 of the Regulation promulgated together with  Circular 03/2023/TT-BGDDT, a semi-boarding public school for ethnic minorities has the following organizational structure:

- The organizational structure of a semi-boarding public school for ethnic minorities shall comply with the provisions of the charter of the public school. In addition, each school has an additional day-boarding student management team to perform the task of managing, nurturing, and taking care of day-boarding students.

- The group managing part-boarding students has a leader, if there are 7 or more members, there is a vice-team. Team leaders and vice-heads are appointed by the principal, under the management and direction of the principal.

The student management team has the following responsibilities:

+ Develop a plan and organize the implementation of management, nurturing, and care of part-boarding students by week, month, semester, and school year; coordinate with professional groups in formulating and implementing the school's educational plan;

+ Organize activities at least once every 2 weeks to review and implement the team's tasks and may hold unscheduled meetings according to work requirements or at the request of the principal;

+ Perform other duties assigned by the principal.
