1. Authority for restoring driver license points in Vietnam

The authority to restore driver license points according to Clause 1, Article 51 of Decree 168/2024/ND-CP is as follows:

- The Director of the Traffic Police Department is responsible for managing and operating the database on handling administrative violations of road traffic order and safety to update and automatically restore driver license points for cases prescribed in Clause 2, Article 51 of Decree 168/2024/ND-CP;

- The Director of the Traffic Police Department and the Head of the Traffic Police Division where the legal knowledge test about road traffic order and safety is conducted have the authority to restore points for the driver license in the cases prescribed in Clause 3, Article 51 of Decree 168/2024/ND-CP.

2. Steps for restoring driver license points in Vietnam in cases where a part of the point on the driver license have been deducted or no points have been deducted

According to Clause 2, Article 51 of Decree 168/2024/ND-CP, the procedure and steps to restore driver license points for cases where a part of the point on the driver license have been deducted or no points have been deducted within 12 months from the date of the most recent point deduction are as follows:

- After a 12-month period, from the date of the most recent point deduction on the driver license, the driver license points data will automatically be restored to a full 12 points (including licenses currently under suspension) and automatically updated in the database on handling administrative violations of road traffic order and safety;

- Immediately after the driver license points data is restored, the database on handling administrative violations of road traffic order and safety will automatically send notification information to the individual whose driver license points are restored according to the provisions at point c, Clause 2, Article 51 of Decree 168/2024/ND-CP;

- The notification of the restoration of driver license points is carried out electronically through the citizen's account registered on the Public Service Portal, Traffic Application on mobile devices; simultaneously updating the information about the driver license with restored points on the official website of the Traffic Police Department. For driver licenses displayed in the form of data messages, the restoration status of driver license points is updated in electronic identification cards, electronic identification accounts on the national identity application.

3. Steps for restoring driver license points in Vietnam in cases where all points on the driver license have been deducted

According to Clause 3, Article 51 of Decree 168/2024/ND-CP, the procedure and steps for restoring driver license points for cases where points are completely deducted are as follows:

- After the individual with a driver license with points completely deducted participates in a legal knowledge test on road traffic order and safety and meets the requirements, the test results are updated into the legal knowledge testing software about road traffic order and safety and data synchronized with the database on handling administrative violations of road traffic order and safety. The driver license points data will be restored to a full 12 points and automatically updated in the database;

- Immediately after the driver license points data is restored to a full 12 points, the competent person as prescribed at point b, Clause 1, Article 51 of Decree 168/2024/ND-CP informs the individual with the restored points on their driver license;

- The notification of restoration of driver license points is executed in writing according to the form issued by the Minister of Public Security and delivered directly or sent via postal service or electronically notified through the citizen's account registered on the Public Service Portal, Traffic Application on mobile devices; simultaneously updating information about the driver license with restored points on the official website of the Traffic Police Department.

For driver licenses displayed in the form of data messages, the agency or competent person updates the restoration status of driver license points in electronic identification cards, electronic identification accounts on the national identity application.
