1. Positions and titles of commune-level cadres in Vietnam

In Clause 1, Article 3 of Decree 92/2009/ND-CP, commune-level officials have the following positions:

- Secretary, Deputy Secretary of the Party Committee;

- Chairman, Vice Chairman of the People's Council;

- Chairman, Vice Chairman of the People's Committee;

- Chairman of Vietnam Fatherland Front Committee;

- Secretary of Ho Chi Minh Communist Youth Union;

- President of Vietnam Women's Union;

- Chairman of the Vietnam Farmers' Association (applicable to communes, wards and townships engaged in agricultural, forestry, fishery and salt production activities and organized by the Vietnam Farmers' Association);

- President of Vietnam Veterans Association.

2. Positions and titles of commune-level civil servants in Vietnam

Commune-level civil servants have the following titles specified in Clause 2, Article 3 of Decree 92/2009/ND-CP:

- Police chief;

- Military commander;

- Office – statistics;

- Cadastral - construction - urban and environment (for wards and townships) or cadastral - agriculture - construction and environment (for communes);

- Accouting financial;

- Justice - civil status;

- Sociocultural.

3. Time to raise the salary level of commune-level cadres and civil servants in Vietnam

Article 6 of Decree 92/2009/ND-CP stipulates on raising the salary level of commune-level cadres and civil servants as follows:

- For commune-level cadres with a salary period of 5 years (full 60 months) specified in Point a, Clause 1, Article 5 of Decree 92/2009/ND-CP, who complete the task but are not disciplined, the salary will be upgraded to level 2.

- Commune-level officials specified at Point b, Clause 1, Article 5 of Decree 92/2009/ND-CP; and commune-level civil servants defined at Point a, Clause 2, Article 5 of Decree 92/2009/ND-CP shall implement the salary increase regime as prescribed in Article 7 of Decree 204/2004/ND-CP.

- Commune-level cadres and civil servants who fail to fulfill their tasks or are disciplined from reprimands or warnings, the salary increase period will be extended for 6 months; if dismissed, the salary increase period will be extended for 12 months from the effective date of the disciplinary decision.

According to Clause 1, Article 7 of Decree 204/2004/ND-CP, salary grade increment is regularly practised on the basis of the professional performance of cadres, civil servants and the duration in which they are entitled to the salary grade within the relevant category or applicable to the title.

The duration in which they are entitled to the salary grade within the relevant category or applicable to the title to be used for consideration of salary increment shall be stipulated as follows:

- For the title of high-ranking experts, who are not entitled to the highest grade in the salary schedule, after 05 years (60 full months) of their service which entitles them to the salary grade in the salary schedules applicable to high-ranking experts, they shall be considered for a one-step salary increment.

- For those listed in Table 2, 3, 4 in Item 1, Article 5 of Decree 204/2004/ND-CP and particular salary schedules of Juridical Courts and Procuracy as provided for in Decision 730/2004/NQ-UBTVQH11, if they are not entitled to the highest salary grade in their salary schedule then, duration in which they are entitled to salary grade within relevant scale or title is to be used for consideration of salary increment shall be stipulated as follows:

+ For those persons listed from A0 to A3 in Table 2, 3, titles listed in particular salary schedules of Juridical Courts and Procuracy: one-step salary increment shall be considered after 03 years (36 months) of service which entitles them to the current salary grade within the relevant salary schedules applicable to category and title.

+ For those persons listed in B, C in Table 2, 3, executive staff and servants listed in Table 4: one-step salary increment shall be considered after 04 years (24 months) of service which entitles them to the current salary grade within the relevant salary schedules applicable to category and title.

+ For the subjects specified at Points a and b, Clause 1, Article 7 of Decree 204/2004/ND-CP, if they fail to fulfill their assigned annual duties or are disciplined in one of the forms of reprimand, warning, demotion, or dismissal, for each year of failing to complete tasks or being disciplined, the time for calculating regular salary increases will be extended compared to the time specified as follows:

++ If the task is not completed or is disciplined in the form of a reprimand or warning, the extension will be extended by six (six) months in comparison to the prescribed time.

++ In case of being disciplined in the form of demotion or dismissal, it will be extended by 12 months (one year) compared to the prescribed time.
