1. General criteria of commune-level civil servants in Vietnam 2023

In Article 3 of Decree 112/2011/ND-CP, general standards are prescribed as follows:

- For civil servants: Office - statistics, land administration - construction - urban and environment (for wards and towns) or Cadastral - agriculture - construction and environment (for communes), Finance - accounting, Justice - civil status, Culture - society:

+ Understanding of political theory, grasping the viewpoints, guidelines, and lines of the Party, policies and laws of the State;

+ Being capable of organizing and mobilizing local people to effectively implement the Party's guidelines and guidelines, and the State's policies and laws;

+ Having the education and professional qualifications suitable to the requirements of the tasks and positions, and having enough capacity and health to complete the assigned tasks;

+ Understanding and respecting the customs and practices of the community in the work area.

- For civil servants, commune-level military commanders, and commune police chiefs:

In addition to the standards specified in Clause 1, Article 3 of Decree 112/2011/ND-CP, they must also be able to coordinate with units of the People's Army, People's Public Security, and other forces in the area to participate in building the all-people national defense and perform a number of civil defense tasks;

Maintaining security, politics, social order, and safety, protect the Party and government, protect the people's lives and property; and protect the State's property.

2. Specific criterua of commune-level civil servants in Vietnam 2023

Pursuant to Article 4 of Decree 112/2011/ND-CP as amended by Decree 34/2019/ND-CP, the specific criteria are stipulated as follows:

- Specific criteria for the title of commune-level civil servant specified in Clause 1, Article 3 of Decree 112/2011/ND-CP shall be prescribed by the Minister of Home Affairs in accordance with the characteristics of rural, urban, and island areas. 

- Specialized laws govern the qualifications for the positions of commune-level military commander and commune police chief.

3. Recruitment bases of commune-level civil servants in Vietnam

Article 5 of Decree 112/2011/ND-CP stipulates recruitment bases as follows:

- The recruitment of commune-level civil servants must be based on task requirements, title standards, and the number of commune-level civil servants assigned to each title by the People's Committee of the province or city directly under the Central Government (hereinafter referred to as the provincial level).

- Commune-level The People's Committees are responsible for formulating annual commune-level civil servant recruitment plans for each title and reporting them to the People's Committees of districts, towns, and provincial cities (district-level) to approve and organize recruitment according to the provisions of Decree 112/2011/ND-CP.

The commune-level civil servant recruitment plan must clearly state the number of assigned commune-level civil servant titles and the number of existing civil servants. The number of civil servants is still lacking compared to the number assigned to each title, as are the registration conditions for recruitment according to each commune-level civil servant title.

4. Recruitment competence of commune-level civil servants in Vietnam

Article 9 of Decree 112/2011/ND-CP stipulates the recruitment competence as follows:

- Presidents of district-level People's Committees shall organize the recruitment of commune-level civil servants according to the provisions of this Decree and the Provincial-level People's Committee's Regulation on organization of the recruitment of commune-level civil servants, except for special cases in the recruitment of commune-level civil servants specified in Article 21 of Decree 112/2011/ND-CP.

- Based on the number of applicants, the President of the district-level People's Committee shall decide on the establishment of the Examination Council or the Selection Council. (The Examination Council, the Selection Council hereinafter referred to as the Recruitment Council).

- In case no recruitment council is established, the district-level Department of Home Affairs shall report to the provincial-level Department of Home Affairs. After obtaining the consent of the Department of Home Affairs, the district-level Department of Home Affairs shall assist the district-level People's Committee Chairman in recruiting commune-level civil servants. When organizing the recruitment of commune-level civil servants, it is still required to set up assisting committees according to the provisions of Clause 2, Article 10 of Decree 112/2011/ND-CP.
