General criteria for commune-level civil servants, according to Article 3 of Decree 112/2011/ND-CP are as follows:
- For civil servants: Office - statistics, Cadastral - construction - urban and environmental planning (for wards and towns); or Cadastral - agriculture - construction and environmental planning (for communes), Finance - accounting, Justice - civil status, Culture - society:
+ Understanding of political theory, grasping the viewpoints, guidelines, and lines of the Party, policies and laws of the State;
+ Capable of organizing and mobilizing local people to effectively implement the Party's guidelines and guidelines, and the State's policies and laws;
+ Having the education and professional qualifications suitable to the requirements of the tasks and positions, and having enough capacity and health to complete the assigned tasks;
+ Understanding and respecting the customs and practices of the community in the work area.
- For civil servants, commune-level military commanders, and commune police chiefs: in addition to the standards specified in Clause 1, Article 3 of Decree 112/2011/ND-CP they must also be able to coordinate with units of the People's Army, People's Public Security, and other forces in the area to participate in building the all-people national defense and perform a number of civil defense tasks;
Maintaining security, politics, social order, and safety; protecting the Party and government; protecting the people's lives and property; and protecting the State's property.
The time limit for issuing decisions on recruitment and accepting jobs with commune-level civil servants in Vietnam according to Article 20 of Decree 112/2011/ND-CP (amended in Decree 34/2019/ND-CP) is as follows:
- For the titles of Office - statistics, Cadastral - construction - urban and environment (for wards and towns) or Cadastral - agriculture - construction and environment (for communes), Finance - accounting, Justice - civil status, Culture - society:
Pursuant to the notice of recognition of the matriculation results specified in Clause 3, Article 19 of Decree 112/2011/ND-CP, the chairperson of the district-level People's Committee shall issue a decision to recruit commune-level civil servants.
- For the position of Commune-level Military Commander and Commune Police Chief:
Pursuant to the notice of recognition of the matriculation results specified in Clause 3, Article 19 of Decree 112/2011/ND-CP, the President of the district-level People's Committee shall decide:
+ Appoint the commune-level military commanders at the written request of the commune-level People's Committee presidents after reaching agreement with the district-level military commanders;
+ Appoint the Chief of the Commune Police at the written request of the Head of the District-level Police Department after reaching agreement with the Chairman of the Commune People's Committee.
- Within 30 days from the date of issuance of the recruitment decision, the person recruited to be a commune-level civil servant must go to the job-receiving agency, unless the recruitment decision prescribes a different time limit.
In case the person recruited into the civil service cannot come to accept the job due to legitimate reasons, he/she must make an application for extension before the end of the above-mentioned time limit and send it to the district-level People's Committee. The time limit for applying for an extension shall not exceed 30 days from the date of expiration of the time limit for receiving a job specified in this clause.
- In case the successful candidate for the commune-level civil servant does not come to accept the job after the deadline specified in Clause 3, Article 20 of Decree 112/2011/ND-CP (amended in Decree 34/2019/ND-CP), then:
The chairperson of the district-level People's Committee shall issue a decision to cancel the recruitment decision, and at the same time issue a recruitment decision to the candidates who are eligible for admission with lower test scores adjacent to them.
