Regarding this issue, LawNet would like to answer as follows:
Pursuant to Article 5 of Joint Circular 24/2015/TTLT-BYT-BGTVT, the procedures for regular check-ups for professional car drivers are prescribed in Articles 5, 8 of the Circular 14/2013/TT-BYT.
- Dossier of medical examination is submitted at ME establishment.
- After receiving dossier of ME, the ME establishments shall implement the jobs:
= Comparing the picture in ME dossier with the person who arrives for ME;
= Affixing with an integrity seal on picture after comparing as prescribed in point a this clause for cases specified in clauses 1, 2 and 3 Article 4 of Circular 14/2013/TT-BYT;
+ Checking and comparing ID card or passport of guardian of person performed ME for case specified in clause 4 Article 4 of Circular 14/2013/TT-BYT;
= Guiding the ME process for the person performed ME, hi/her guardian (if any);
= ME establishments implement ME under process.
Specifically, Article 14 of Joint Circular 24/2015/TTLT-BYT-BGTVT stipulates expenses for check-ups for professional car drivers in Vietnam as follows:
- Agencies, organizations, and individuals requesting check-ups for drivers must pay expenses for medical facilities according to price level approved by competent state administration agencies or negotiated between two units.
- Drivers who need more than one health certificate shall be charged more for a check-up according to laws.
- Check-ups for drivers as prescribed in Clause 3, Article 11 of Joint Circular 24/2015/TTLT-BYT-BGTVT shall be paid by agencies that make requests.
Responsibilities of drivers during check-ups in Vietnam are specified in Article 10 of Joint Circular 24/2015/TTLT-BYT-BGTVT as follows:
- Provide adequate and true information about health conditions, medical history of their own and take responsibility to laws for such information when going for check-ups;
- Follow instructions provided by health workers through the check-up;
- Proactively go for a check-up again after undergoing treatment for diseases or injuries caused by accidents that may affect driving performance;
- Comply with requirements for regular or irregular check-ups given by health and transport authorities (Vietnam Road Administration, the Services of Transport of central-affiliated cities and provinces) or employers;
According to Article 9 of Joint Circular 24/2015/TTLT-BYT-BGTVT, responsibilities of health workers and medical facilities for doing check-ups for drivers include:
- Health workers
= Perform duties as assigned by competent persons
= Check identity before carrying out check-ups;
= Perform procedures and professional services as instructed to guarantee check-up results are true and accurate and take responsibility to laws for conclusions made;
= For cases difficult to conclude, medical professional shall make proposals for medical consultation as prescribed;
- Responsibilities of medical facilities
= Follow provisions as prescribed of Joint Circular 24/2015/TTLT-BYT-BGTVT and take responsibility to laws for check-up results concluded;
= Keep medical records of drivers, compile and report check-ups and professional performance of medical facilities according to laws on statistical reports;
