Vietnam: State agencies must proactively apologize to the wronged person

This is a notable content of the Law on State Compensation Liability 2017 approved on June 20, 2017 by the 14th National Assembly of Vietnam.

According to the Law on State Compensation Liability 2017 of Vietnam, the restoration of honor of a sufferer in criminal procedures shall be conducted in the following forms:

- Directly apologizing and publicly rectifying:

+ at the place where the sufferer being individual has been residing; or

+ where the sufferer being corporation has been headquartered;

- Publishing public apology and making public rectification.

Within 15 days from the date on which the document serving as ground for claim is issued or the judgment/decision referred to in Article 55 of this Law becomes effective, the enforcer’s superior body shall have to notify the sufferer of the honor restoration by the state.

The Law on State Compensation Liability 2017 of Vietnam takes effect from July 01, 2018, replacing the Law on State Compensation Liability 2009.
