Using Water Resources Without a Permit Subject to a Fine of up to VND 250 Million

On March 24, 2020, the Government of Vietnam issued Decree 36/2020/ND-CP on penalties for administrative violations in the field of minerals.

The acts of exploration, exploitation, and use of water resources without registration or permits as required shall be subject to penalties as follows:

- Failing to register as required for acts of exploration and exploitation of groundwater: a warning or a fine ranging from VND 100,000 to VND 500,000;- Conducting groundwater exploration without a permit: a fine ranging from VND 2,000,000 to VND 40,000,000;- Exploiting and using groundwater for production, business, and service activities with a volume from over 10 m³/day-night to under 30 m³/day-night: a fine ranging from VND 5,000,000 to VND 10,000,000;- Exploiting and using water resources without a permit: a fine ranging from VND 10,000,000 to VND 250,000,000.

Note: Acts of exploration, exploitation, and use of water resources when the permit has expired are subject to the same penalties as having no permit.
