The Minister of Industry and Trade of Vietnam issued Circular 12/2022/TT-BCT dated 25/7/2022 stipulating regulations on working hours and break for employees who operate, maintain and repair gas distribution pipelines and gas sites.
According to the Circular, the regulations on breaks between working sessions for employees who operate, maintain, and repair the gas distribution pipeline system and construction related to gas in Vietnam are as follows:
After the working session, the employee shall have a break with the number of days off equal to the number of working days in the previous working session.
A working session includes the total number of continuous working days of an employee in a shift from the time he arrives to the time he leaves the production facility, excluding travel time.
In addition, the regulations on breaks during working hours, between shifts, and public holidays in Vietnam are as follows:
- Break during working hours:
+ Take breaks during working hours in accordance with Article 109 of Vietnam's Labor Code.
+ The transition time between two adjacent working shifts must not exceed 45 minutes.
- Inter-shift breaks; holidays, Tet; annual leave; unpaid leave and other leave
+ Inter-shift breaks; holidays, Tet; annual leave; unpaid leave adn other leave shall follow the provisions of Article 110, Article 112 and Article 115 of Vietnam's Labor Code.
+ Annual leave shall follow the regulations of Articles 113 and 114 of Vietnam's Labor Code. If it is not possible to arrange annual leave for the employee, the employer shall agree with the employee on the annual leave during the shift break.
Circular 12/2022/TT-BCT takes effect from September 9, 2022.
