On November 30, 2024, the National Assembly of Vietnam passed the Law on Data 2024. This law will take effect from July 1, 2025.
The Law on Data 2024 stipulates digital data; building, developing, protecting, managing, processing, and using digital data; the National Data Center; the National General Database; products and services related to digital data; state management of digital data; and the rights, obligations, responsibilities of agencies, organizations, and individuals associated with digital data activities in Vietnam.
Regarding the application of the Law on Data 2024:
- In the case where other laws enacted before the Law on Data 2024 takes effect contain provisions on the construction, development, protection, management, processing, and use of data; data-related products and services; state management of data, responsibilities of agencies, organizations, and individuals related to data activities that do not contradict the principles of the Law on Data 2024, such laws shall be followed.
- In the case where other laws enacted after the Law on Data 2024 takes effect contain provisions differing from those of the Law on Data 2024, it is necessary to specify the content to be implemented or not implemented according to the Law on Data 2024 and the content to be implemented according to those other laws.
The prohibitions under the Law on Data 2024 include:
- Exploiting data processing, data management, development, business, circulation of data products and services to infringe upon national, ethnic, defense, security, social order, and safety interests, public interest, and lawful rights and interests of agencies, organizations, and individuals.
- Illegally obstructing or preventing the process of data processing, data management or attacking, appropriating, destroying databases, or information systems serving the management, processing, management, protection of data.
- Forging, intentionally falsifying, losing, or damaging data in the databases of the Communist Party, State, Vietnam Fatherland Front Committee, and socio-political organizations.
- Intentionally providing false data or failing to provide data as prescribed by law.
