On November 30, 2024, the National Assembly of Vietnam passed the Electricity Law 2024.

Guidelines for basic investigation of renewable energy electricity resources, new energy electricity in Vietnam from February 1, 2025

According to the provisions of Article 21 of the Electricity Law 2024, the basic investigation of renewable energy resources and new energy electricity in Vietnam is conducted as follows:

- The scope of the basic investigation of renewable energy resources and new energy electricity within the territory of Vietnam includes:

+ Solar energy, wind energy, geothermal energy resources;

+ Wave energy, tidal energy, and other forms of energy resources from ocean sources;

+ Energy resources from municipal and urban solid waste;

+ Biomass energy resources;

+ Energy resources from production, business waste outside the objects specified in point c, clause 1, Article 21 of the Electricity Law 2024;

+ Hydropower resources.

- Responsibilities for organizing the basic investigation of renewable energy resources and new energy electricity are stipulated as follows:

+ The authority and responsibility for conducting the basic investigation of renewable energy resources and new energy electricity in the Vietnamese marine areas are carried out following the law on maritime affairs, and the law on marine resources, environment, and islands;

+ The authority and responsibility for conducting the basic investigation of hydropower resources are carried out according to the law on water resources;

+ Except as provided in point d, clause 2, Article 21 of the Electricity Law 2024, the provincial-level People's Committee shall take charge of organizing the basic investigation of renewable energy resources and new energy electricity on the mainland and islands within their administrative boundaries;

+ The Ministry of Natural Resources and Environment of Vietnam assigns enterprises wholly owned by the State and a public service provider with the function of conducting basic investigations of marine resources and environment to take charge of performing the tasks in designated sea areas under the Vietnamese sea.

- The State encourages the mobilization of lawful financial resources and contributions in science and technology from organizations and individuals to serve the basic investigation tasks.

- Information and data specified in clause 1, Article 21 of the Electricity Law 2024 are the input for the planning organization and the consulting unit to use for drafting the development plan of electricity, provincial planning. In the areas lacking information and data specified in clause 4, Article 21, the planning organization is responsible for collecting reliable and appropriate data to perform the task as required by law. The Ministry of Natural Resources and Environment aggregates information and data nationwide as specified in clause 1, Article 21 of the Electricity Law 2024.

- The Ministry of Natural Resources and Environment of Vietnam and the provincial-level People's Committees manage, publish, and share information about the basic investigation of renewable energy resources and new energy electricity according to legal regulations.

- The funding for conducting the basic investigation specified in clause 1, Article 21 of the Electricity Law 2024 is allocated from the following sources:

+ The state budget;

+ The funds of the enterprises wholly owned by the State to be responsible for arranging from the operational production and business costs and other lawful capital sources;

+ Funds from organizations and individuals voluntarily sponsoring for the basic investigation tasks.

- The Minister of Natural Resources and Environment specifies the detailed scope of the basic investigation as prescribed in clause 1, Article 21 of the Electricity Law 2024, except for contents executed under the law on water resources, and the law on marine resources, environment, and islands.

Refer to Electricity Law 2024 effective from February 1, 2025.

The Electricity Law 2004 (amended in 2012) will expire from the date the Electricity Law 2024 becomes effective, except as provided in clauses 1, 2, 3, and 4, Article 81 of the Electricity Law 2024.
