Key Document Highlights from October 16, 2021 to October 21, 2021

During the past week (from October 16, 2023, to October 21, 2023), the Legal Secretary has updated many new documents in various fields such as commerce, finance, and labor. Notable among them are the following Decrees and Circulars:

  1. Automobile Manufacturing Enterprises Must Have a Test Track at Least 800m Long

This is the minimum requirement mentioned in Decree 116/2017/ND-CP, regulating the conditions for production, assembly, importation, and business of automobile warranty and maintenance services.

All automobiles manufactured and assembled by the enterprise must be test-driven on a test track that meets the following minimum technical requirements:

- The test track must be at least 800 meters long;- Ensure the technical requirements to check the quality of the produced, assembled cars before leaving the factory on various roads to test features such as:- Flat roads: Test acceleration, gear shifting, main brake system, steering system;- Gravel roads: Test noise, strange sounds, sound insulation, and sound absorption;- Rough roads: Test the durability of the suspension system, shock absorbers, and body vibrations;- Wave-like roads: Test the durability of the car body and frame.

  1. Temporarily Hold Security Money for JCL Enforcement of Commercial Entities

Decree 115/2017/ND-CP, effective from January 1, 2018, regulates the temporary holding of security money deposited for judgment enforcement (JCL) of commercial entities as follows:

- During the investigation and prosecution stage: The money deposited for JCL is temporarily held in the temporary holding account opened at the State Treasury (KBNN) by the Investigative Authority conducting the proceedings;- During the trial stage: The money deposited for JCL is temporarily held in the temporary holding account opened at the KBNN of the Civil Judgment Enforcement Authority at the same level as the Court of First Instance where the trial takes place;- The money deposited for JCL according to the decision of the Military Investigative Authority, Military Procuracy, Military Court is temporarily held in the temporary holding account of the corresponding financial authorities in the Army opened at the KBNN.

After the decision to bring the case to trial, the money deposited in the temporary holding account of the Investigative Authority must be transferred to the temporary holding account of the Civil Judgment Enforcement Authority at the same level as the Court of First Instance handling the case.

  1. Establish a Supervisory Board for the Race Before Organizing Betting

This is a regulation of Circular 101/2017/TT-BTC guiding Decree 06/2017/ND-CP on business betting on horse racing, greyhound racing, and international soccer. Accordingly:

- Before organizing betting business activities, the betting business on horse racing and greyhound racing enterprises must send a written request to the Department of Finance where the racecourse is located to establish a Supervisory Board for the race;- Within 15 days from the date of receiving the request from the enterprise, the Department of Finance shall submit to the Provincial People's Committee where the racecourse is located:- The decision to establish the Supervisory Board for the race;- Approval of the operational regulations of the Supervisory Board for the race.- When there is a change in the members of the Supervisory Board for the race, the Department of Finance shall report to the Provincial People's Committee for consideration and decision on the personnel change of the Supervisory Board for the race.

Circular 101/2017/TT-BTC is effective from December 1, 2017.

  1. New Guidelines on Salary and Allowances for Cryptographic Staff

The Ministry of Home Affairs issued Circular 07/2017/TT-BNV guiding the implementation of salary policies for those working in cryptographic organizations receiving salaries and allowances from the state budget, replacing Joint Circular 24/2005/TTLT-BNV-BTC.

From December 1, 2017, the salary policies and allowances for those working in cryptographic organizations on the state payroll have some notable new points such as:

- The cryptographic rank salary table denotes 10 grades (currently only 9 grades), that is, adding grade 10, equivalent to the salary coefficient of a Major General level, which is 9.20.- The title of Chief of the Government Cryptographic Department is ranked at the highest cryptographic rank, which is grade 10 (salary coefficient of 9.2). Currently, it is ranked at grade 9 with a salary coefficient of 8.60.- Cryptographic workers who have reached the highest cryptographic rank when due for promotion and meet the standards but are not appointed to a higher position may be considered for a salary increase of 9.20 or 9.80.
